Ascension Parish Chief Criminal Deputy Tony Bacala reports the arrest of a Donaldsonville couple after their minor aged daughter narrowly escapes a fatal gunshot

On Sept. 30, 2012, shortly after midnight, deputies were dispatched to Prevost Hospital to investigate an accidental shooting. They met with an 8 year old and her mother, Jennifer Mitchell, who told authorities that the 8 year old had found her .38 caliber handgun in her mother's nightstand. They indicated that the 8-year-old took the weapon from the nightstand and that it accidentally discharged. Fortunately, the projectile only grazed the child's chest causing superficial wound. The child was treated and later released from the hospital.

During the course of the investigation deputies received information that Mrs. Mitchell had fabricated the story and had induced the 8-year-old daughter to make untruthful statements to the investigating deputies.

It was discovered that Jennifer Mitchell was in a heated argument with her husband, Henry Mitchell, Sr. During the argument, Jennifer reportedly armed herself with the pistol and it accidentally discharged with the one shot completely penetrating and exiting Henry's leg and also hitting the 8-year-old child.

Jennifer Duncan Mitchell, 31, of 127 Evangeline Street Donaldsonville was arrested and charged with aggravated battery (Domestic Violence), negligent Injury, contributing to delinquency of a juvenile, and criminal mischief (filing a false police report).

Henry Mitchell, Sr., 46, of 127 Evangeline Street Donaldsonville was arrested and charged with simple assault (domestic violence), accessory after the fact to negligent injury, contributing to the delinquency of a juvenile, and obstruction of justice.

Both are currently incarcerated with no bond set at this time. The Mitchells 3 children, including the 8-year-old were taken into the custody by Office of Child Services (OCS) and are expected to be released to their grandmother.
