Copies of the proposed revised Ascension Parish Pupil Progression Plan will be available in the Ascension Parish School Board Office and at Donaldsonville High School, Dutchtown High School, East Ascension High School and St. Amant High School for public review and comment during school hours from Monday, July 15 through Friday, July 27, 2012.
The public is invited to go to the site of their choice, review the plan and make any comments or suggestions concerning the proposed revised Pupil Progression Plan.
The plan will be submitted to the school board for approval on Tuesday, August 21, 2012, and then placed on file in the Louisiana Department of Education. Once approved, the Pupil Progression Plan shall be incorporated into the Ascension Parish School Board Policy Manual.

ORDINANCE
Purpose: Pursuant to the Ascension Parish Charter Sections 4-12 and 6-01, to abolish the East Ascension Parish Hospital Service District (EAPHSD), to repeal Section 18-50 of the Parish Code of Ordinances [which created the EAPHSD] , and related matters.
WHEREAS, in Section 18-50 of Article V of the Parish Code of Ordinances adopted in the year 1962, the Parish of Ascension created the East Ascension Parish Hospital Service District (EAPHSD);
WHEREAS, since the creation of the East Ascension Hospital Service District, the Service District has dutifully served its purpose and mission;
WHEREAS, the Commissioners of the East Ascension Parish Hospital Service District, through their Chairperson Cynthia Stafford, advised the Council of the Parish of Ascension at a Parish Council meeting on June 21, 2012 that, due to the current delivery systems for health and medical care and the state of the health care industry, that it is cost prohibitive to continue the mission and purpose of the East Ascension Parish Hospital Service District;
WHEREAS, the Commissioners of the East Ascension Parish Hospital Service District further suggested that the East Ascension Parish Hospital Service District be abolished; and
WHEREAS, the Charter of the Parish of Ascension in Sections 4-12 and 6-01 provide that the Parish governing authority may abolish special districts and agencies within the Parish, including but not limited to, the East Ascension Parish Hospital Service District, and repeal Ordinances;
THEREFORE BE IT ORDAINED, that the Ascension Parish Council, as the governing authority of the Parish of Ascension, does hereby adopt this Ordinance as follows:
Section 18-50 of the Parish Code of Ordinances is hereby repealed.
The East Ascension Parish Hospital Service District (EAPHSD) is abolished.
By operation of law and this Ordinance, all property and improvements (moveable and immovable), assets, cash, funds of any type or source, accounts receivables, liabilities, obligations, and contracts of the East Ascension Parish Hospital Service District (EAPHSD) shall be and hereby are the property, assets, improvements, cash, funds, accounts receivables, liabilities, obligations, and contracts of the Parish of Ascension.
Said property includes the following described immovable property owned and acquired by the by East Ascension Parish Hospital Service District (EAPHSD) on December 13, 1965 (less and except any subsequent conveyances or sell-offs):
A certain tract of land situated in the Parish of Ascension, State of Louisiana, in the North Half of the North Half of the Northwest Quarter of Section 33, Township 9 South, Range 3 East, Southeastern District of Louisiana, and being more particularly described as commencing at the Northeast corner of the Northwest Quarter of Section 33, and measures South 0 degrees 8 minutes West along the east boundary of the Northwest Quarter of Section 33 a distance of 663.1 feet to the North boundary of the South Half of the North Half of the Northwest Quarter of Section 33, then South 89 degrees 35 minutes West along the North boundary of the South Half of the North Half of the Northwest Quarter of Section 33 a distance of 1579.18 feet, then North 0 degrees 8 minutes East a distance of 666.53 feet to the North boundary of Section 33, then North 89 degrees 43 minutes East a distance of 1579.05 fee to the point of beginning, containing 24.105 acres, all as is more fully shown on the plan of survey prepared by Durald F. Woods, C.E., dated Lutcher, La., July 26, 1965, a blueprint of which is annexed hereto and made part hereof.
The Parish President is authorized to sign and execute any documents and agreements required to effectuate and facilitate this Ordinance including, but not limited to, any documents regarding the transfer of title or ownership of property or funds from the East Ascension Parish Hospital Service District (EAPHSD) to the Parish of Ascension.
This Ordinance is adopted in conformity with Sections 4-12 and 6-01 of the Ascension Parish Charter.
This Ordinance having been submitted to a vote, the vote thereon was as follows:

The Council of the Parish of Ascension, Louisiana, met in regular session on Thursday July 5, 2012 6:00 p.m., in the Ascension Parish Courthouse Annex, 300 Houmas Street, Donaldsonville, Louisiana, with Council Chairman Chris Loar presiding.
The opening prayer and the pledge was offered by Mr. Red Loupe.
The following Council members were present:

Councilman Todd Lambert was absent.
Chairman Loar announced that they would pass on Agenda Item #11 – Resolution – approving the issuance, sale and delivery of not exceeding $550,000 of Certificates and Indebtness, of the Ascension Parish Consolidated Utilities District #1, State of Louisiana. He said that the Bond Counsel was not prepared and requested more time.
Parish President invited Ms. Janet Dewey-Kollen, Executive Director of the Baton Rouge Affiliate of Susan G. Komen for the Cure. She informed the Council upcoming event in Ascension, the “Pink Ribbon Scramble”.
President Tommy Martinez presented the Council with an excerpt from House Bill #1 that read “$100,000 shall be distributed to the Ascension Parish Government for promotion and related expenses for the Louisiana Hot Air Balloon Festival Championship” and explained that at the last Legislative Session, Senator Amedee added the support of the Balloon Festival in Ascension Parish. President Martinez respectfully requested that the funds be dispersed by Ascension Parish and explained that the funds would be reimbursed by late September or early October.
Councilman Benny Johnson made the motion to approve dispersal of $100,000 for the Louisiana Hot Air Balloon Festival Championship. The motion was seconded by Councilman Randy Clouatre with no objection. The motion passed.
Vice Chairwoman Teri Casso presented the recommendations of the Personnel Committee as follows:
** Appointment to Industrial Development Board – Mr. Anthony Bacala. Motion to appoint by Councilman Kent Schexnaydre and seconded by Councilman Benny Johnson to appoint Mr. Bacala to replace Mr. Don Hanna. He will serve a six year term ending on May 4, 2018.
**Reappointment to Ascension Parish Library - Ms. Sandy Scallan was reappointed to a five year term ending on June 20, 2017 on a motion by Councilman Randy Clouatre and seconded by Councilman Dempsey Lambert.
** Reappointment to the Human Resources Review Board - Mr. Wilbert Darrell Curtis was reappointed to a four year term ending on April 4, 2016 on a motion by Councilman Benny Johnson and a second by Councilman Kent Schexnaydre.
** Reappointments to the Waterways Commission – Mr. Casey Owens was reappointed to a two-year term ending on December 31, 2014 on a motion by Councilman Randy Clouatre and a second by Councilman Dempsey Lambert.
** Mr. Bo Matherne was reappointed to a two-year term ending on December 31, 2014 on a motion by Councilman Benny Johnson and a second by Councilman Randy Clouatre.

Strategic Planning Chairman Kent Schexnaydre said they have been working on the problem of white goods and debris removal for the last seven years. He reported that he gets numerous calls about service. He said they would negotiate and have proposals to do a non-exclusive franchise with three vendors held responsible to adhere to a certain minimum standard and cost. He offered it in the form of a motion. The motion was seconded by Councilman Benny Johnson.
Councilman Turner made an amended motion to include in the original motion to have a minimum requirement of twice weekly pickup and once weekly recycling pickup. The amended motion was seconded by Councilman Oliver Joseph. There were objections to the amended motion made by Councilman Bryan Melancon and Councilman Daniel Satterlee. A roll call vote was conducted in a accordance with law, with the results as follows:

Chairman Loar invited Mr. Bill Dawson up to give a status on the Resolution. He reported the resolution was still not ready to be voted on by the Council. He said the Secretary of State responded to the Bond Counsel’s last question on July 3rd. The final resolution will now have to be approved by the Fire District #1 Board then presented to the Council for final consideration on July 19th.
After a lengthy discussion, Councilman Benny Johnson made a motion to postpone the Resolution for the Fire District #1 Proposal for 15 Mill Property Tax until the proposal is received. Councilman Oliver Joseph seconded the motion. The motion passed with no objection.
Chief Architect Mike Burturla with Bryan Bush, Inc. presented the Certificate of Substantial Completion for Fire Station 31 on Highway 929, Bryan Bush Construction, Inc. Councilman Benny Johnson made a motion to approve the Certificate of Substantial Completion. Councilwoman Casso seconded the motion. The motion passed.

WHEREAS: the Parish of Ascension, through the Ascension Parish Council under lawful session, passed an ordinance adopting an official Personnel Policy Manual for the Parish of Ascension; and
WHEREAS: the original ordinance established a uniform system for managing personnel matters to assure compliance with applicable state and federal laws and provide for the standards, terms, and conditions of employment with the Parish of Ascension; and
WHEREAS: the manual is in need of revision; and
BE IT ORDAINED that the Ascension Parish Council does hereby authorize the amendments proposed by the Human Resources Department and submitted by the Parish President attached hereto and made a part hereof as Exhibit A. This Exhibit A is available for review in the office of the Ascension Parish Human Resources Department, 114 Nicholls St., Donaldsonville, LA 70346.
EFFECTIVE DATE: This ordinance shall be in full effect as permitted by law.

The Council of the Parish of Ascension, Louisiana, met in regular session on Thursday June 21, 2012 6:00 p.m., in the Ascension Parish Courthouse 828 S. Irma Blvd. Gonzales, Louisiana, with Council Chairman Chris Loar presiding.
The opening prayer and the pledge was offered Ms. Deanna Lafont with Ascension Economic Development Corporation.
The following Council members were present:

Item 5 – Presentations – Proclamation – St. Elizabeth CEO Dee LeJeune was passed on as it was addressed at a prior meeting.
Chairman Loar announced he would pull item 7c – Parish Transportation – Initiative Program – Resolution – Council to cal election and 7f – Fire District #1 Tax Proposal for 15 mill property tax from the consent agenda.
Parish President Tommy Martinez invited Ms. Cynthia Stafford to the podium to speak about the East Ascension Hospital Service District Board. Ms. Stafford reported that year after year they have made changes and tried different strategies but they always knew the money would run out. She said they decided to lease the hospital with the permission of the Parish President. They chose Promise Healthcare. She said with the income they made from Promise Health Care’s lease, they put together a program for social workers to be placed in high risk schools. The program has been a huge success. She reported that Promise Healthcare decided not to renew their lease and that they could only lease a part of the building which would not cover the hospital’s expenses. She said the board would like to return the hospital to the Parish along with five million dollars in attached funds.
Parish President Martinez informed the Council that the thought process was to turn the hospital into a government building and locate most of the government offices at this location. Councilman Randy Clouatre made a motion to allow the Parish President to move forward and to look into the feasibility of Parish Government moving to and maintaining the hospital. Councilman Benny Johnson seconded the motion and it passed with no objection.
President Martinez asked Councilman Schexnaydre to speak on the 5th Annual Bourgeois Family Fundraiser, “A Time to Remember”. Councilman Schexnaydre announced that it would take place on Sunday June 24, 2012 at the Clarion Inn in Gonzales.

Councilman Satterlee inquired as to why Consent Agenda Item #7f – Fire District #1 Tax Proposal for 15 mill property tax was passed on. Chairman Loar confirmed that it was because it was not ready and told him that it would be placed on another Council Meeting in the future when it is ready. Bond Counsel Malcolm Dugas advised that it would be placed on the July 5, 2012 Council Agenda. He said that it would be on the December ballot. Councilman Satterlee said he was concerned about it being at a smaller election because of low voter turnout.
Strategic Planning Committee Kent Schexnaydre reported on the recommendations of the Strategic Planning Committee meeting. He made a motion to approve the new Adjudicated Hearing Officer, Rick Alessi. Councilman Turner seconded the motion and no objections were made. The motion passed.
Tommy Lejeune with Faulk and Winkler presented the 2011 Audit for Ascension Parish Government. He gave a Power Point presentation.
Chairman Loar presented the approval of the Resolution of the Ascension Parish Sales Tax District #2- authorization to add to the November 6, 2012 ballot a one-half percent sales tax for twenty-five years beginning on January 1, 2013 to construct, acquire, extend, expand, improve, maintain and operate roads and bridges. A Resolution granting approval to Ascension Parish Sales Tax District No. 2 of the Parish of Ascension, State of Louisiana (the “District”), to call and hold an election on November 6, 2012, to authorize the levy and collection of a 1/2% sales and use tax for a period of 25 years, beginning January 1, 2013, to construct, acquire, improve and maintain roads and bridges.
WHEREAS, Ascension Parish Sales Tax District No. 2 of the Parish of Ascension, State of Louisiana (the “District”) adopted a Resolution on June 21, 2012 (the “District Resolution”) ordering and calling a special election to be held in the District on November 6, 2012, for the purpose of authorizing the levy and collection of a 1/2% sales and use tax for a period of 25 years, beginning January 1, 2013, for the purpose of constructing, acquiring, improving and maintaining roads and bridges (the “Tax”), all in the manner conferred by Article VI, Section 29 of the Louisiana Constitution of 1974, as amended and the applicable provisions of Chapter 5 and Chapter 6-A of Title 18 of the Louisiana Revised Statutes of 1950, as amended, and other constitutional and statutory authority, a copy of which is on file with the Parish Council of the Parish of Ascension, State of Louisiana, as governing authority of the Parish of Ascension, State of Louisiana (the “Parish Council”).
WHEREAS, the District has made application to the Parish Council for approval to call and hold such election on November 6, 2012, as more fully set forth in the District Resolution.
WHEREAS, Article VI, Section 15 of the Louisiana Constitution of 1974, as amended and Section 1415 of Title 33 of the Louisiana Revised Statutes of 1950, as amended, grant power to the Parish Council to approve any proposal submitted by the District to levy a tax.
NOW, THEREFORE, BE IT RESOLVED by the Parish Council, as the governing authority of the Parish of Ascension, State of Louisiana, that:
SECTION 1. Pursuant to a request submitted to this Parish Council by the District and in accordance with Article VI, Section 15 of the Louisiana Constitution of 1974, as amended and La. R.S. 33:1415, approval is hereby granted to the District to call and hold an election on November 6, 2012, for the purpose of authorizing the levy and collection of a 1/2% sales and use tax for a period of 25 years, beginning January 1, 2013, for the purpose of constructing, acquiring, improving and maintaining roads and bridges (the “Tax”), in the manner conferred by Article VI, Section 29 of the Louisiana Constitution of 1974, as amended, and the applicable provisions of Chapter 5 and Chapter 6-A of Title 18 of the Louisiana Revised Statutes of 1950, as amended, and other constitutional and statutory authority and as more fully set forth in the District Resolution.

PURPOSE: To declare as surplus property, two (2) parcels of immovable property currently owned by the Parish of Ascension bearing the following municipal addresses, 39129 W. Worthey Road, Gonzales La., and 39222 W. Worthey Road, Gonzales, La.. Once designated as surplus property, the Parish of Ascension shall sell said surplus property pursuant to LSA-R.S. 33:4712, et seq.
WHEREAS, the Parish of Ascension, owns property more particularly described in “Exhibit “A,” attached hereto and made a part hereof, that was initially acquired for the purposes of the West Worthey Road Widening Project No. 01-W-05, by council action on January 19, 2006, and December 4, 2008.
WHEREAS, the Ascension Parish Council, through the powers granted under the Home Rule Charter, has the authority to declare property belonging to the Parish as surplus and transfer said property according to law; and
WHEREAS, it is the high recommendation of the Ascension Parish President that said property be declared surplus and transferred according to law; and

PURPOSE:
To revoke a portion of a twelve foot utility servitude located on and across Lot 99 of the second filing of Oak Alley Estates.
WHEREAS, the petitioners have petitioned the Ascension Parish Council to revoke a portion of the dedication, more specifically described in the attached exhibit; and
WHEREAS, the Departments of Public Works and Engineering have reviewed and researched said request and have reported their findings to the Ascension Parish Planning Commission; and
WHEREAS, the Ascension Parish Planning Commission, upon review of said petition, and after having considered all of the facts relevant to this request, has recommended approval of the proposed revocation request.

DRAINAGE DESIGN FOR RAINFALL EVENT, CLARIFYING THE TEN (10) YEAR DESIGN CRITERIA IS FOR A TWENTY FOUR (24) HOUR RAIN EVENT, BY MODIFYING SECTION 17-4045 (A) ASCENSION PARISH UNIFIED LAND DEVLOPMENT CODE, AND PROVIDES FOR SEVERABILITY, AND EFFECTIVE DATE
PURPOSE: The purpose of this ordinance is to:
Clarify that the design criteria that is used when designing a drainage plan / system for development shall utilize the twenty four (24) hour rainfall event as determined by the current technical paper published by the National Weather Service. This criterion is already identified in section 17-5013(A); therefore, section 17-4045(A) conflicts with this requirement. This proposed amendment will make the two regulations match to clean up the discrepancy.
WHEREAS: Ascension Parish is a local governmental subdivision as defined by Article VI, Section 44 of the Louisiana Constitution of 1974, and
WHEREAS: The Parish of Ascension is the governing and responsible body over the zoning and regulations within this jurisdiction, and
WHEREAS: Article VI of the Home Rule Charter of Ascension Parish, adopted May 4, 1993, identifies the process and manner in which to adopt ordinances regulating the lands of this parish, and
WHEREAS: The Ascension Parish Regional Planning Commission adopted the “Subdivision Regulations” as part of the “Official Plan of the Parish” in accordance with Louisiana Revised Statues on January 21, 1971, and
WHEREAS: The Parish Council adopted this regulation as Appendix IV of the Unified Land Development Code on December 17, 2009 (Ord. DC09-09), and
WHEREAS: It is necessary to make the change to clarify to discrepancy within the code for consistent enforcement of public life safety and welfare.
BE IT ORDAINED by the Ascension Parish Governing Authority that Section 17-4045, Paragraph A of the Ascension Parish Unified Land Development Code is amended as follows: (additions are underlined and deletions are strikethrough)
17-4045 Drainage: Design and Construction Criteria
All drainage design shall be predicated on based on calculations of a ten (10) year storm frequency of one (1) hour duration. twenty-four (24) hour rainfall as determined by Technical Paper 40 published by the National Weather Service (currently 8.5 inches)
SEVERABLITY: In the event that any portion of this Ordinance is ever held invalid or unconstitutional for any reason by any court of competent jurisdiction over it, such portion shall be deemed a separate, distinct, and independent provision and shall not affect the validity of the remaining portions of the Ordinance.
EFFECTIVE DATE: This ordinance shall be in full effect as permitted by law.

Mrs. Pujol said that after many years of dedicated service to our parish she recommended that the board accept Mrs. Bailey’s retirement. On a motion by Mr. Murphy and second by Mrs. Davis, the board unanimously approved the above recommendation.

Under Committee Reports, Mr. Murphy said that the Insurance Committee met tonight to discuss health and vision insurance plan renewals. For the past four years there has not been an increase in insurance premiums. He said that the committee will recommend approving a 5% increase on Plan I with a few changes in benefits for the medical plan for the 2012-2013 plan year due to substantial drop in our fund balance. They also recommend the renewal of EyeMed Vision Care with no premium increase and rate guarantee for four years. Approval of these items will be placed on the next school board meeting agenda.

Under Superintendent Comments, Mrs. Pujol noted the following:
Recent publicity showed a study performed by Education Trust with Ascension Parish being one of five parishes across the nation highlighted in the study on improving teaching conditions in high poverty schools. National media has also picked up on the story.
A positive article on Turnaround Zone was recently published in the local paper
Virtual Learning – initially we focused on 6th – 12th grade. We have recently had the opportunity to look at a program that would give us capacity on the lower end- K-6/8 for people who are home schooling or thinking about home schooling. Funding would be less expensive if we participated in K-6/8 Virtual Learning as opposed to the parish sending money with a student to attend a Charter School.
The board voted to participate in a lawsuit against the voucher program. On the next consent agenda Mrs. Pujol will recommend that the board approve Robert Hammonds serving as Attorney to represent our school system.
July 31 – 5:00 P.M. has been tentatively set for Board Member Training with Bob Hammonds to give an update on legislation.
AMI Kids in Donaldsonville will no longer be funded by the Office of Juvenile Justice. With the changes in Virtual Learning, our need for services at AMI Kids will lessen. Mrs. Pujol will be meeting with AMI to re-negotiate our relationship with the program.
Reminder - Data Center Ribbon Cutting Ceremony will be July 17 – 5:00 P.M.
Under Board Comments, Mrs. Wimberly said she checked with local restaurants/residents to help sponsor the idea of recognizing retired employees. After checking with Ms. Graves they thought that recognizing employees quarterly would be better than doing it once a year. Mrs. Wimberly has received response from Sno’s Restaurant who is willing to provide gift certificates.
There was no discussion on Action Item Review.

The Parish of Ascension is seeking a pavement management service to survey condition data, geometric data, and sign location data for all Parish maintained public roads.
The ideal management service company will survey all Parish maintained public roads and provide the Parish with usable data to determine condition and geometry of each roadway. The data shall be in the format for PavementView/Cartegraph asset management system. The contract will require selected company to provide all resources and be required to build from the existing Parish database.
Ascension Parish currently maintains approximately 492 miles of two lane roads. The Parish employs version 8.3b of the PavementView module of the CarteGraph Asset Management System (PavementView). All Parish roads have had segment IDs assigned; however, no condition or geometric data has been collected or entered into PavementView. The Parish is requesting qualification statements from interested firms who can provide data collection services, and who can turn over the collected data in a format which is compatible with PavementView.
