NOTICE IS GIVEN pursuant to Section 21(D) of Article IV of the Louisiana Constitution for 1974 that AT&T Louisiana has filed a tariff with the Louisiana Public Service Commission on July 6, 2012.  This filing increases the rate in Zone 1 exchanges to $7.86 per month, and the rate in Zone 2 and 3 exchanges to $6.82 per month for Residence Local Optional Service (LOS) Option B and also increases the rate to $11.75 for Expanded Local Area Calling, effective July 22, 2012.  If you wish additional information regarding this tariff filing, you may contact your AT&T Louisiana representative.

Motion by Councilman Milton Vicknair and seconded by Councilman John Wright to approve the minutes of the regular meeting of the Mayor and Council taken Tuesday, June 19, 2012.  Motion carried.  Vote as follows:

Mayor Pro-tem Randy Anny opened the public hearing to discuss ordinance 12-05, setting the millage for 2012.

An ordinance to set 6.11 mills as the adjusted rate for 2012.

BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF SORRENTO THAT: the Town of Sorrento of the Parish of Ascension, Louisiana, in a public meeting/hearing held on July 3, 2012, which meeting/hearing was conducted in accordance with the Open Meetings Law and the additional requirements of Article VII, Section 23(C) of the Louisiana Constitution and R.S. 47:1705(B), that the following adjusted millage rates be and they are hereby levied upon the dollar of the assessed valuation of all property subject to ad valorem taxation within said Parish for the year 2012, for the purpose of raising revenue:

BE IT FURTHER ORDAINED that the Assessor of the Parish of Ascension shall extend upon the assessment roll for the year 2012 the taxes herein levied, and the tax collector of said Parish shall collect and remit the same to said taxing authority in accordance with law.

The foregoing resolution was read in full, the roll was called on the adoption thereof, and the resolution was adopted by the following votes:

Motion by John Wright and seconded by Councilman Randy Anny to approve the Louisiana Compliance Questionnaire, a required part of the financial audit of the town.  Motion carried.  Vote as follows:

Councilman Milton Vickanir introduced ordinance 12-06, an ordinance adopting the new policies and procedures for the town.  A public hearing was called for the next regular meeting of the mayor and town council on Tuesday August 7, 2012 at 6:00 pm at the Sorrento town hall to consider adoption of this ordinance.

Motion by Milton Vicknair and seconded by Councilman John Wright to authorize the town attorney to contact the developer of Orange Grove Subdivision to get information on the development.  Motion carried.  Vote as follows:

NAYS: None

ABSENT:  Charles Day, Marvin Martin

Motion by Milton Vicknair and seconded by Councilman John Wright to go into executive session to review and consider a town personnel matter.  Motion carried.  Vote as follows:

The contract will require selected company to provide all resources and be required to build from the existing Parish database.

Ascension Parish currently maintains approximately 492 miles of two lane roads.  The Parish employs version 8.3b of the PavementView module of the CarteGraph Asset Management System (PavementView).  All Parish roads have had segment IDs assigned; however, no condition or geometric data has been collected or entered into PavementView.  The Parish is requesting qualification statements from interested firms who can provide data collection services, and who can turn over the collected data in a format which is compatible with PavementView.

WATER DISCHARGE PERMIT

The LDEQ, Office of Environmental Services, is accepting written comments on a  Louisiana Pollutant Discharge Elimination System (LPDES) permit prepared for Intership Services, Inc., New Orleans Facility, 2439 Marietta Street #2, Kenner, Louisiana 70062.  The facility will operate between River Miles 44 and 187 on the Mississippi River in Plaquemines, St. Bernard, Orleans, Jefferson, St. Charles, St. John the Baptist, St. James, Ascension, Iberville, East Baton Rouge and West Baton Rouge  Parishes.

The principal discharge from this proposed source will be made into the Mississippi River, waters of the state classified for primary contact recreation, secondary contact recreation, propagation of fish and wildlife and drinking water supply.  Under the SIC  3731, the applicant proposes to discharge dry commodity ship hold washwater and coal and coke ship hold washwater from a proposed oceangoing ship hold cleaning facility.

During the preparation of this permit, it has been determined that the discharge will have no adverse impact on the existing uses of the receiving waterbody.  As with any discharge, however, some change in existing water quality may occur.

The Special Meeting of the East Ascension Consolidated Gravity Drainage District 1 Commission Meeting was held on June 13, 2012 at 5:20 P. M. in the Council Meeting Room, Courthouse Annex, Gonzales, Louisiana.

Chairman Randy Clouatre called the meeting to order.

The invocation was given by Randy Clouatre and the Pledge of Allegiance was recited by all present.

Members Present:  Daniel Satterlee, Dempsey Lambert, Randy Clouatre, Travis Turner, Benny Johnson and Todd Lambert

Members Absent:  Bryan Melancon, Kent Schexnaydre, Chris Loar, and Terri Casso

Agenda Item #4 – Consideration of declaring a state of emergency at the Frog Bayou Locks and Bluff Swamp Drainage Basin due to structural failure of the locks.

Mr. Bill Roux explained the situation in the Frog Bayou and Bluff Swamp Drainage Basin.  Additional comments were made by Commission Members and Parish President.  There was a discussion.

A motion was made by Dempsey Lambert and seconded by Benny Johnson to adopt the Frog Bayou / Bluff Swamp Resolution.  No objections. Motion carried.  (Resolution attached to and here to made part hereof).

There being no further business to come before this Commission, a motion was made by Todd Lambert and seconded by Benny Johnson to adjourn.  No objections.  Motion carried.

Agenda item #7 – Approval of Low Bid-Hydraulic Driven Severe Duty Tree & Brush Mower, Installed

A motion was made by Dempsey Lambert and seconded by Kent Schexnaydre to accept the lowest responsive bid after review from the Purchasing Department and EAD from Wetland Equipment Company, Inc. for a Hydraulic Driven Severe Duty Tree and Brush Mower and to authorize the Parish President to enter into any applicable agreement or contract for the project.  No objections.  Motion carried.

Agenda item #8 – Drainage Servitude Encroachment / Revocation Request-Cedar Grove Subdivision –Lot 45

A motion was made by Kent Schexnaydre and seconded by Dempsey Lambert to accept East Ascension Consolidated Gravity Drainage District #1 as having no objection to the encroachment and revocation of approximately 2.5  feet of drainage servitude along the east side of Lot 45, Cedar

Grove Subdivision.  

Additional comments were made by Todd Lambert and Daniel Satterlee.

No objections.  Motion carried.  

Agenda item #9-Drainage Servitude Revocation Request-Tracks E-1 & E-2, Annie Virginia Brignac Estate

A motion was made by Kent Schexnaydre and seconded by Todd Lambert to accept East Ascension Consolidated Gravity Drainage District #1 as having no objection to the revocation of drainage servitude along the rear of tracks E-1 and E-2, Annie Brignac Estate.  No objections.  Motion carried.

Agenda item #10-HMGP 1607-005-002 Elevation Project-Site 1-1220

A motion was made by Todd Lambert and seconded by Dempsey Lambert to authorize Parish President Tommy Martinez to enter into a Cooperative Endeavor Agreement with homeowner for the elevation of Site 1 -1220 in the amount of $113,000.00 under HMGP in accordance with all FEMA required documents.  No objections.  Motion carried.

Agenda item #11A-Executive Session –Moran Property Access Road Lawsuit update

A motion was made by Benny Johnson and seconded by Daniel Satterlee to recess from its regular order of business and reconvene into executive session. No objections.  Motion carried.

A motion was made by Kent Schexnaydre and seconded by Travis Turner to recess from its regular order of business and reconvene into executive session. No objections.  Motion carried.

A motion was made by Travis Turner and seconded by Kent Schexnaydre to accept a Resolution authorizing the hiring of special counsel Robert Barnett to defend the East Ascension Consolidated Gravity Drainage District #1 in the Alligator Bayou litigation at a rate not to exceed the attorney general rate and to waive any conflict associated with his representation of the Parish of Ascension in the same litigation. No objections.  Motion carried.

There being no further business to come before this Commission, a motion was made by Todd Lambert and seconded by Chris Loar to adjourn.  No objections.  Motion carried.

Copies of the proposed revised Ascension Parish Pupil Progression Plan will be available in the Ascension Parish School Board Office and at Donaldsonville High School, Dutchtown High School, East Ascension High School and St. Amant High School for public review and comment during school hours from Monday, July 15  through Friday, July 27, 2012.

The public is invited to go to the site of their choice, review the plan and make any comments or suggestions concerning the proposed revised Pupil Progression Plan.

The plan will be submitted to the school board for approval on Tuesday, August 21, 2012, and then placed on file in the Louisiana Department of Education.  Once approved, the Pupil Progression Plan shall be incorporated into the Ascension Parish School Board Policy Manual.

EPA is authorized under Section 309(g) of the Clean Water Act, 33 U.S.C.  1319(g), to assess a civil penalty after providing the person subject to the penalty notice of the proposed penalty and the opportunity for a hearing, and after providing interested persons public notice of the proposed penalty and a reasonable opportunity to comment on its issuance.  Under Section 309(g), any person who without authorization discharges a pollutant to a navigable water, as those terms are defined in Section 502 of the Act, 33 U.S.C.  1362, may be administratively assessed a civil penalty of up to $37,500 by EPA.  Class I proceedings for Section 309(g) of the Clean Water Act are conducted in accordance with the “Consolidated Rules of Practice Governing the Administrative Assessment of Civil Penalties, Issuance of Compliance or Corrective Action Orders, Revocation, Termination or Suspension of Permits”, 64 Fed. Reg. 40138 (July 23, 1999)(Part 22”), including Rules related to Administrative Proceedings not Governed by  554 of the Administrative Procedures Act, 40 C.F.R.  22.50 - 22.52
