ZONING CHANGE ID 2212.12, CHANGING THE OFFICIAL ZONING DESIGNATION OF 1.250 ACRES IDENTIFIED AS TRACT CS-2 OF THE LOIS LEBLANC ROSSI PROPERTY FROM MEDIUM INTENSITY RESIDENTIAL (RM) TO MIXED USE 2 (MU2), PROVIDES FOR SEVERABILITY, AND AN EFFECTIVE DATE.

PURPOSE: This ordinance amends the official zoning designation of Tract CS-2 of the Lois LeBlanc Rossi Property from Medium Intensity Residential (RM) to Mixed Use 2 (MU2) at the request of the Zoning Commission.

WHEREAS: Ascension Parish is a local governmental subdivision as defined by Article VI, Section 44 of the Louisiana Constitution of 1974, and

WHEREAS: Article VI of the Home Rule Charter of Ascension Parish, adopted May 4, 1993, identifies the process and manner in which to adopt ordinances regulating the lands of this Parish, and

WHEREAS: The Parish Council reserves the authority to make changes to the official zoning map by ordinance, and

WHEREAS: This request has been processed in compliance with the procedures set forth.

BE IT ORDAINED by the Ascension Parish Governing Authority that the official Zoning Map of Ascension Parish Louisiana is amended to reflect the property identified in Exhibit A as “Mixed Use2” (MU2) as the official zoning designation.

SEVERABILITY:  In the event that any portion of this Ordinance is ever held invalid or unconstitutional for any reason by any court of competent jurisdiction over it, such portion shall be deemed a separate, distinct, and independent provision and shall not affect the validity of the remaining portions of the Ordinance.

CORPORATION

FOR EXCEPTION TO LPSC ORDER NO. U-20181 AND APPROVAL OF

METHOD FOR RECOVERY OF ACCRUED EXPENSE AND CHANGE IN RATES

Atmos Energy Corporation has filed a petition with the Louisiana Public Service Commission for an exception to LPSC Order No.U-20181 requiring a utility to book post-retirement benefits other than pensions on a pay-as-you-go basis and has requested approval of a method to recover the accrued expense resulting from the gap between accounting for post-retirement benefits other than pensions on a pay-as-you-go basis as compared to an accrual basis as required by FAS 106.  Atmos Energy Corporation has proposed three options for recovery of the accrued expense and the approval of any of the three options will result in an increase in the rates paid by customers of both, Trans Louisiana Gas and Louisiana Gas Service, regulatory divisions of Atmos Energy Corporation in 49 parishes in Louisiana, including the parish in which this notice is published. The increase in rates will take effect upon approval by the Louisiana Public Service Commission.

The Council of the Parish of Ascension, Louisiana, met in regular session on Thursday June 7, 2012 6:00 p.m., in the Ascension Parish Courthouse Annex, 300 Houmas Street, Donaldsonville, Louisiana, with Council Chairman Chris Loar presiding.

The opening prayer was offered by Reverend Charles Brown, Emmanuel Baptist Church. The pledge was led by  Chairman of the Bayou Lafourche Fresh Water District, Mr. Hugh Caffery.

Parish President Tommy Martinez invited the Chairman of the Bayou Lafourche Fresh Water District, Mr. Hugh Caffery to the podium to give a presentation on the Bayou Lafourche Fresh Water District’s status to date. He also recognized the Director, Archie Chaison and two local representatives, Mr. Gene Harrell and Mr. Malcolm Dugas. There was a brief discussion following the presentation.     

The consent agenda was approved on a motion by Councilwoman Bryan Melancon and a second to the motion by Councilman Todd Lambert as follows:

Mr. Richard Throckmorton presented the Condemnation Proceedings for 3067 Broussard Road, Donaldsonville, LA.  Mr. Throckmorton presented the Council with a timeline and pictures of the property. The motion to condemn was made by Councilman Todd Lambert and seconded by Councilman Dempsey Lambert. No objections were made. The motion passed.

Legal Counsel O’Neil Parenton explained the Resolution – Approval of alpha splits for precincts 01, 02, 06, 07, 08, 11, 26, 37, 40, and 71 as recommended by the Ascension Parish Registrar of Voters, Mr. Robert Poche. The Council unanimously approved the alpha splits on a motion by Councilman Benny Johnson and a second by Councilwoman Teri Casso.

Ben Laurie, Chief Engineer presented the Approval of Change Order No. 1 with MWH Americas, Inc in the amount of $9,550.00 for additional Engineering Design as required by DOTD for the LA 42 Sewer Design Project. He explained that this change order was additional charges that were a result of changes made by DOTD. A motion to approve was made by Councilman Todd Lambert and seconded by Councilman Benny Johnson. The motion passed with no objection.

The next agenda item was a Cooperative Endeavor Agreement between the Parish of Ascension and Westlake Vinyls for Project Stardust.  Councilman Todd Lambert recused himself from this item and left his seat in the chambers before discussion ensued. There was one speaker on this item: Mr. Sam Baker. Legal Counsel O’Neil Parenton explained that the ordinance for this project had already been passed and that this is only the contract for the agreement.

    Councilman Turner made a motion to hold off on the agreement until Westlake Vinyls met with Geismar community members. Councilman Todd Lambert seconded the motion for discussion. A substitute motion was made by Councilman Kent Schexnaydre to add a Resolution to the CEA requesting that Westlake Vinyls communicate with the community of Geismar. The substitute motion passed unanimously with a second by Councilman Bryan Melancon.

    Councilman Kent Schexnaydre presented the recommendation from the Strategic  Planning Committee to approve the demolition of the ACUD Facility and to give notice to ACUD to vacate the building. There were speakers on this item as follows:

Councilman Benny Johnson made a motion to approve the demolition of the ACUD Facility and to give notice to ACUD to vacate the building. Councilwoman Teri Casso seconded the motion. Councilman Satterlee made a substitute motion to postpone the item until Councilman Joseph was able to be involved in the decision. The substitute motion was seconded by Councilman Todd Lambert. There were objections to the substitute motion.

A roll call vote was conducted on the substitute motion with the results as follows:

The Council unanimously agreed to hold a public hearing on June 21, 2012 in the Ascension Parish Courthouse, 828 S. Irma Blvd Gonzales, Louisiana, to consider an ordinance to amend the Ascension Parish Zoning map from Medium Intensity Residential (RM) to Mixed Use 2 (MU2) – Tract CS-2 of the Lois Leblanc Rossi Property for Candace E.R. Smith located on the south side of LA Highway 74 approximately 2100’ east of LA Highway 938 (Coontrap Road) on a motion  by Councilman Bryan Melancon and a second by Councilman Todd Lambert.

Legal Counsel O’Neil Parenton read the ordinance to amend the Parish Unified Land Development Code – Appendix IV, Section 17-4032 Street Requirements, (A)(1) Density Restrictions. A motion to open the public hearing was made by Councilman Todd Lambert and seconded by Councilman Randy Clouatre. No speakers came forth. The public hearing was unanimously closed on a motion by Councilman Todd Lambert and a second by Councilman Bryan Melancon.

PURPOSE:   The purpose of this ordinance is to revise language in the ordinance.

WHEREAS: Ascension Parish is a local governmental subdivision as defined by Article VI, Section 44 of the Louisiana Constitution of 1974, and

WHEREAS: The Parish of Ascension is the governing and responsible body within this jurisdiction, and

WHEREAS: Article VI of the Home Rule Charter of Ascension Parish, adopted May 4, 1993, Identifies the process and manner in which to adopt ordinances regulating the lands of this Parish, and

WHEREAS: This code was incorporated as Appendix IV of the Parish Unified Land Development Code adopted December 17, 2009, and

BE IT ORDAINED by the Ascension Parish Governing Authority that Section 17-4032 of the Ascension Parish Unified Land Development Code is hereby amended as follows. These changes are adopted as follows:

Street Requirements

The Commission shall apply the following rules in evaluation of subdivision applications.

Density restrictions: considering any proposed major or minor subdivision which exist on any street which is less than 18 feet wide of asphalt, concrete or other hard surface, the developer shall secure a sixty (60) foot right of way along the street from his development to a street designated by the Department of Public Works in and for the Parish of Ascension, Engineering Review Agency and approval of the Parish Planning and Zoning Commission.

Density Restrictions

No major or minor subdivision may be developed on any street which is less than 18’ in pavement width.

Any division of property of eight (8) or less of the parent tract is exempt from this provision.

Legal Counsel O’Neil Parenton read the ordinance to state the Ascension Parish Council’s endorsement of Project Boxwood – Methanex, to participate in the benefits of the Louisiana Quality Jobs Program. The public hearing was opened on a motion by Councilman Daniel Satterlee and seconded by Councilman Todd Lambert. No objections were made. The public hearing was opened. There was one speaker on this item: Mr. Mike Eades.

Mr. Eades, the Economic Development Director asked that the Ordinance be amended to read “approximately 120 jobs” would be provided. He stated that Methanex was uncomfortable with a promise of exactly 120 jobs being provided. He suggested that there be a “sliding scale” for the number of jobs related to the amount of the rebate.

The public hearing was closed with no objection on a motion by Councilman Bryan Melancon and a second by Councilman Todd Lambert.

    Councilman Randy Clouatre made a motion to adopt the ordinance. Councilman Benny Johnson seconded the motion.

    Councilman Kent Schexnaydre offered an amended motion to amend the ordinance to include a provision that the percentage of the rebate is conditioned upon the number of jobs. The motion was seconded by Councilman Travis Turner. The subsequent ordinance was adopted with proposed amendments.

ORDINANCE

PURPOSE:

To state the Ascension Parish Council’s endorsement of Methanex USA LLC’s Project Boxwood (the “Project”), to participate in the benefits of the Louisiana Enterprise Zone Program/Quality Jobs Program.

WHEREAS: the Louisiana Enterprise Zone Program/Quality Jobs Program offers significant incentives for economic development to some of the most distressed areas in the State and;

WHEREAS, the Ascension Parish Council states the endorsement is in agreement with the overall economic development plan for Ascension Parish, and;

WHEREAS, in accordance with the Louisiana Enterprise Zone Program/Quality Jobs Program requirements, the Ascension Parish Council agrees:

To Participate in the Enterprise Zone Program/Quality Jobs Program;

To assist the Department of Economic Development in evaluating the progress made in any Enterprise Zone Program/Quality Jobs Program within its jurisdiction;

To REBATE one (1) cent of eligible surplus Ascension Parish sales/use taxes on the purchase of eligible construction materials, machinery, and equipment purchased for the Project and used permanently by the Methanex USA LLC plant in Ascension Parish, Louisiana and found to be in compliance with the Louisiana Enterprise Zone Act/Quality Jobs Program.

The REBATE shall be used for the purposes of reimbursing only Methanex USA LLC’s direct cost of the construction and initial equipping of the Project at the Methanex USA LLC plant in Ascension Parish Louisiana.

Methanex USA LLC shall submit receipts associated with the cost of construction and initial equipping of the Project to the Parish Sales Tax Authority for which REBATE is sought and after proof acknowledgment that Ascension Parish did in fact collect said sales taxes, the Ascension Parish Sales Tax Authority shall forward said request with recommendations to the Ascension Parish Treasurer for approval.

The REBATE estimated to be $1,610,000.00 is conditioned upon the creation of one hundred twenty (120) direct new full time jobs by Methanex USA LLC’s employment company. Furthermore, METHANEX USA LLC shall provide evidence that at least five (5) of the new jobs created will have sufficient hourly earnings and the offer of sufficient company paid healthcare benefits as required to qualify for the State of Louisiana’s Quality Jobs Program.

However, should METHANEX USA LLC fail to create one hundred twenty (120) direct new full time jobs, as voted hereinabove, the rebate shall be reduced to a pro rata basis for jobs not created. (For illustrative purposes only: should Methanex USA LLC create

one hundred fifteen jobs, the rebate will be limited to 95.833% of the amount of the rebate if Methanex USA LLC created 120 direct new full time jobs).

The REBATE is payable for eligible expenditures occurring during the Project Period only. The Project Period shall be the same as the project period approved by the Louisiana Board of Commerce and Industry for Methanex USA LLC’s state Enterprise Zone/Quality Jobs contract for Project. Methanex USA LLC will provide a copy of the state Enterprise Zone/Quality Jobs contract to the Ascension Parish Treasurer within thirty (30) days of the execution of said contract.

BE IT ORDAINED, that the Ascension Parish Council in due, regular and legal session convened that Methanex USA LLC and its project are endorsed to participate in the Louisiana Enterprise Zone Program/Quality Jobs Program.

BE IT FURTHER ORDAINED that the Ascension Parish Council, as the governing authority in and for the Parish of Ascension will reimburse one cent from the Ascension Parish Government local sales tax of the eligible sales taxes collected for the construction of a plant by Methanex USA LLC’s Project, said amount estimated to be $1,610,000.00 from surplus funds, provided such sales taxes were collected and received. Any further rebates must be approved by the Parish Council.

BE IT FURTHER ORDAINED, that the Ascension Parish Treasurer is authorized to begin escrowing on a monthly basis a pro-rata share of the sales tax collected until the sum of $1,610,000.00 dollars is reached. Upon completion of the Project, and due proof presented, the Treasurer shall be authorized to rebate the sales tax held in escrow up to 110% of $1,610,000.00 without further council action.

BE IT FURTHER ORDAINED, that the Parish Treasurer is authorized to require whatever documentation is necessary in her judgment to assure the project is complete.

BE IT FURTHER ORDAINED that if any provision or item of this ordinance or the application thereof is held invalid, such invalidity shall not affect other provisions, items or applications which can be given effect without the invalid provisions, items or applications, and to this end, the provisions of this ordinance are hereby declared servable.

BE IT FURTHER ORDAINED that this ordinance shall take effect immediately.

BE IT FURTHER ORDAINED that all ordinances or parts thereof in conflict herewith are hereby repealed.     

EFFECTIVE DATE:  This ordinance shall be in full effect as permitted by law.

Legal Counsel O’Neil Parenton read the ordinance to amend the Ascension Parish Code of Ordinances, Chapter 14 Offenses and Miscellaneous Provisions, Article III, Noise, Section 14-41-14-47.

The public hearing was unanimously opened on a motion by Councilman Todd Lambert and a second by Councilman Randy Clouatre. There was one speaker on this item: Martin Kraft. With no other speakers, the public hearing was closed with no objection on a motion by Councilman Todd Lambert and a second by Councilman Bryan Melancon.

Councilman Todd Lambert made a motion to adopt the ordinance. Councilwoman Casso seconded the motion. After some discussion, Councilman Bryan The Melancon made an amended motion to adopt the ordinance with the correction of the typo that read “water waves” instead of “waterways”. PURPOSE:

To amend the Ascension Parish Code of Ordinances, Chapter 14 Offenses and Miscellaneous Provisions, Article III. Noise, Section 14-41 – 14-47, entirely, including additions.

            WHEREAS: Ascension Parish is a local governmental subdivision as defined by Article VI, Section 44 of the Louisiana Constitution of 1974, and

           WHEREAS:  Parish of Ascension is the governing and responsible body over Offenses and Miscellaneous Provisions.

WHEREAS: Article VI of the Home Rule Charter of Ascension Parish, adopted May 4, 1993, identifies the process and manner in which to adopt ordinances regulating the laws of this parish, and

WHEREAS: The Code of Ordinances, Chapter 14, Article III, Section 14-41 – 14-47 was last amended on August 19, 2008.

NOW THEREFORE, BE IT ORDAINED by the Ascension Parish Governing Authority that the Code of Ordinances of Ascension Parish, Chapter 14 Offenses and Miscellaneous Provisions, Article III., Noise, Section 14-41 – 14-47, be amended as follows:

Sec. 14-41. Noises interfering with enjoyment of property or public peace and comfort.

It is the intent of the Parish Council to endeavor to provide citizens with an environment free from such excess sounds or noise as may jeopardize their health, welfare and safety, or degrade the quality of life.

For the purposes of this article:

Construction activities shall mean any and all activity incidental to the construction, erection, demolition, assembling, altering, installing or equipping of buildings, structures, roads or appurtenances thereto, including land clearing, grading, excavating and filling.

Construction equipment shall mean construction activity utilizing any equipment or devices such as, but not limited to, pile drivers, power shovels, derricks, hoist tractors, loaders, rollers, concrete hauling motor vehicles, pavement breakers, bulldozers, crawler-tractors, rotary drills and augers, cranes, ditchers, trenchers, scrapers, wagons, pumps, compressors, pneumatic power equipment, or other mechanical apparatus operated by fuel or electric power in the construction, repair or demolition of any building, structure, land, street, alley, waterways, or appurtenance thereto.

db(A) shall mean a measure of sound pressure level in decibels on the A-weighted scale.

Decibel meter shall mean an instrument to measure decibels which meets or exceeds American National Standards Institute (ANSI) section 1.4, 1971(r.1976) standards for type 2 special purpose meters.

Device shall mean any mechanism which is intended to produce or which actually produces sound when operated or handled.

Noise shall mean any sound which exceeds the prescribed decibel levels at a time and location described in the article.

Person shall mean and include any individual, corporation, association, partnership or limited partnership.

Property line shall mean the boundary line distinguishing ownership or the common wall of a townhouse, condominium or leased premises.

Residential district shall have the same meaning as in the Zoning Ordinance of the Parish, including rural districts, conservation districts, medium intensity residential districts, or any other residential district as authorized by the Parish Council.

Sound shall mean that which is or can be heard, or particularly a temporal and spatial oscillation in pressure, or other physical quality, in a medium with internal forces that cause compression and rarefaction of that medium and which propagates at finite speed to distant points.

Sound-amplifying equipment shall mean any machine or device for the amplification of the human voice, music or any other sound or noise.

Sec. 14-43. Loudspeakers and amplifiers.

General Restriction. It shall be unlawful for any person to use, operate or permit to be used or operated any device, radio, musical instrument, television, phonograph, drum, sound-amplifying equipment or device which produces or reproduces sound either stationary or mobile, in such a manner so as to create any sounds or noise which exceeds seventy-five (75) db(A) during the hours of 6:00 a.m. until 9:00 p.m. or which exceed seventy (70) db(A) from 9:00 p.m. until 6:00 a.m. at any property line within a residential district or upon any public street or right-or-way within or bordering upon any residential district within the unincorporated limits of the Parish.

Loud or raucous sounds or noises. It shall be unlawful for any person to willfully make, cause or continue any noise which disturbs the peace or quiet of any residential district and which exceeds seventy-five (75) db(A) during the hours of 6:00 a.m. until 9:00 p.m. or which exceeds seventy (70) db(A) from 9:00 p.m. until 6:00 a.m. at any property line within a residential district or upon any public street or right-of-way within, or bordering upon, any residential district within the unincorporated limits of the Parish.

Responsibility for creation of noise. Any person creating any such sound or noise as described in this section and/or anyone permitting such a sound or noise to be created in, or emanate from, any premises under his care, custody or control shall be presumed responsible for any such sound or noise.

Sec. 14-44. Variances and exceptions.

Emergency and public work. Noise or sound created in the performance of public service by governmental agencies or their contractors; or emergency work engaged in by persons for the public safety, health or welfare; or to restore property to a safe condition following a public emergency; or work to restore essential public services, including construction activities directly related to the abatement of any emergency, shall not be subject to the provisions of this article.

Noises from authorized activities. The prohibitions of this article shall not apply to air traffic at airports, parades, cultural event, athletic games, state or county fairs, or functions conducted pursuant to a permit specifically approved by the Parish of Ascension or other appropriate governmental agency. Issuance of a business license shall not constitute approval of, or authorization by the Parish council within the meaning of this section.

Sirens, horns and whistles. The provisions of this article shall not apply to any siren, whistle, horn or bell used by emergency vehicles or civil defense or used by motor vehicles, trains and boats as warning devices to avoid collisions.

Bells or chimes. The provisions of this article shall not apply to any bell or chimes, or any device for the production or reproduction of the sound thereof which are associated with a clock or time-keeping device, a church or school.

Burglar alarms. The provisions of this article shall not apply to any burglar alarm or security device; provided, however, no burglar alarm or security device shall sound for more than fifteen (15) minutes after being activated.

Construction activity or equipment. The provisions of this article shall not apply to any construction activity or equipment operated between the hours of 6:00 a.m. to 9:00 p.m.

Domestic power equipment. The provisions of this article shall not apply to any domestic power equipment operated between the hours of 6:00 a.m. to 9:00 p.m.

Vessels. The provisions of this article shall not apply to the operation of any motor boat or vessel on any lake, river, stream or waterway.

Motor vehicles and trains. The provisions of this article shall not apply to the normal and usual operation of motor vehicles and trains.

Sec. 14-45. Penalties.

It shall be unlawful for any person to use, operate, or permit to be used or operated in a motor vehicle any sound-amplifying equipment, including, but not limited to, radios, compact disc players and cassette tape players which produces or reproduces sound in such a manner as to create any sounds or noise which exceeds seventy-five (75) db(A) on any public street or right-of-way in Ascension Parish which are not incorporated into the city limits of Gonzales, Donaldsonville, Sorrento, those areas being specifically covered by their respective municipal ordinance.

Sec. 14-46. Variances

Variance permit.

The parish council shall have the authority, consistent with this section, to grant special variances which may be requested when it finds or determines that:

Strict conformance with the provisions of this article would cause a hardship upon any person; or

The offending noise will be for a short duration and compliance with this article will be impractical; or

The benefit in the community of the activity creating the offending noise is greater than the adverse effect on the community of the noise created; or

The applicant needs additional time to modify equipment or take other action in order to comply with the provisions of this article.

Notice of an application for a variance granted under this section shall be published in the same manner as provided for notice of ordinances in Ascension Parish, and shall be granted only after the matter is considered in a hearing at a regularly scheduled council meeting.

The sheriff of Ascension Parish may grant an application for a variance (as) a temporary permit to exceed levels established herein until action is taken by the parish council on the application for a variance.

Special variances shall be granted by notice to the applicant containing all necessary conditions, including a time limit on the permitted activity. The special variance shall not become effective until all conditions are agreed to by applicant. Noncompliance with any condition of a special variance shall terminate it and subject the person holding it to those provisions of this ordinance regulating the source of sound or activity for which the special variance was granted. Application for extension of time limits specified in special variances or for modification of other substantial conditions shall be treated like applications for initial variances.

Sec. 14-47. Administrative Adjudication - Penalties.

Violation of these Sections shall be adjudicated under the provisions of Article VIII., Code Enforcement by Administrative Adjudication of the Ascension Parish Code of Ordinances.

SEVERABILITY:  In the event that any portion of this Ordinance is ever held invalid or unconstitutional for any reason by any court of competent jurisdiction over it, such portion shall be deemed a separate, distinct, and independent provisions and shall not affect the validity of the remaining portions of the Ordinance.

EFFECTIVE DATE:  This ordinance shall be in full effect as permitted by law.

Mrs. Pujol discussed previously with the board, the option to join in on challenging Act 2 recently passed by Louisiana Legislature and signed into law by Governor Jindal.  This law calls for state funds to be used in support of students in private and parochial school.  It was moved by Mrs. Russo and seconded by Mrs. Davis to approve a resolution to engage in litigation concerning constitutionality and, or legality of Act 2 of the 2012 Regular Session of the Louisiana Legislature. (Attachment A)  The following vote was taken:

Mr. John Diez discussed with the board a potential business partnership with Emerson, a new industry locating in Ascension Parish.  The plan would be to locate a control systems and software applications divisional unit in our parish.  This would present a 10 million dollar project.  Mr. Gautreau said that Emerson is the cadillac of control systems and this would be a very exciting idea.  Mr. Irvin did not have a problem with Emerson coming to Ascension Parish; however, he did object to the location that is being considered.

Mr. Nickens asked that all board members meet with Mr. Diez regarding redistricting.

Mrs. Pujol said that there was a recent incident on a construction site where a contractor was electrocuted.  She commended employees at St. Amant Primary School and St. Amant Middle School who used some training techniques to save a man’s life.  Mrs. Pujol called on Mrs. Debbie Gautreau, School Nurse Coordinator, to speak on the incident.  Mrs. Gautreau said that AEDs has been in the schools since 2009 and mock drills are conducted at each site twice a year.  She is so proud of the team who responded so amazingly and of Mrs. Crooks who was not at school that day, but knew her team could handle a situation of this nature.   The general contractor could not be here tonight, but extended his thanks and appreciation to all involved. Mr. Johnnie Balfantz thanked Mrs. Gautreau and Mr. Songy for their persistence in getting the machines into the schools.  Mr. Chad Lynch also extended sincere thanks and gratitude to the team and all involved in saving this man’s life.  Mr. Gautreau thanked Mrs. Debbie Gautreau for following through and also thanked Mr. Harold Jarreau and James LeBlanc for pushing to have AEDs placed in all schools.  The following employees were recognized for their courageous efforts:

Mr. Pearce said that the Insurance Committee met tonight to discuss the overview and renewal of Workers’ Compensation Insurance.  He said that the committee recommends that the board switch from LWCC to LUBA.  This item will be placed on the June 19, agenda for approval.

Mr. Pearce said that the Maintenance Committee met on May 22.  The following report was given:

Jeff Parent updated the Maintenance Committee on the DRAFT 2012-2013 Maintenance Budget.  The DRAFT budget was reduced 8.2% from the 2011-2012 budget.

Jeff Parent updated the Maintenance Committee on the current status of the Johnson Controls Energy Management Contract.  Johnson Controls presented their current charts and graphs on energy consumption and savings across the district.  In the first 6 months of the contract we have saved $363,087 against a target of $414,006.

Mr. Pearce scheduled an Insurance Committee meeting for June 19, at 6:00 P.M.

Mr. Diez cancelled the Athletic Committee scheduled for June 19, at 5:30 P.M.

Mr. Bourgeois scheduled a Transportation Committee Meeting for June 19, at 5:30.

Mr. Gautreau scheduled a Strategic Planning Committee Meeting for June 19, at 5:00 P.M.

Mr. Diez said that the Technology Committee met on May 22, 2012.  The following report was given:

Technology Project Reports

Mr. Ragusa reported that we are awaiting materials for the projector-mounting project, but we still plan on completing that this summer. Mr. Kerry Diez asked how long until the materials arrive. Mr. Ragusa commented that he expects them to arrive in the next week or two.

Blackboard is receiving a major aesthetic upgrade or facelift this summer and we will be enabling the mobile tools for iPhone and android devices. Moose Pearce asked about some of the technical issues with parents and Mr. Ragusa commented that most of those were corrected, but a few of them were permissions issues that will be corrected this summer in the upgrades.

Mr. Ragusa said that one-to-one planning for next year is continuing. We hope to have recommendations in June for next year’s project. Mrs. Pujol referenced the Scientific Learning Corp. which distributes the Fast ForWord® and Reading Assistant™ family of products. These are scientifically-proven, intervention programs that apply neuroscience principles to build the fundamental cognitive skills required to read and learn. She and Mrs. Tuttleton described the initiative to use these tools as part of an aggressive plan in the Turn Around Zone. The impact of this project on the budget is causing a delay until next week on the final budget and planning for One-to-One.

Mr. Ragusa reported that we are working on enhancements and on an upgrade to the APSB Data Warehouse and we will begin an aggressive training program in mid-June that will begin with administrators. He commented that beginning in July we will add teachers and this training will continue until ALL APSB teachers can use the system. Mrs. Pujol commented that she is looking forward to teachers in their PLC’s (Professional Learning Communities) that will be accessing this data to plan for the success of their students.

Technology Purchasing (Bids and RFPs)

Miscellaneous item technology bids were completed, awarded and presented to board by Mr. Fontenot last month. Very significant savings were attained by the purchasing department by reducing the cost on printer toner and other products by over 50%.

Working with the Accounting department on 2 RFP’s, (1) Time Management and (2) Substitute Calling.

Financials Upgrade Progress Report

Many recommendations are being discussed with the accounting department for the future.

The Parish is soliciting proposals for professional services to provide a regulatory approved and licensed disposal site (facility) for type 2 grease/biosolids from the Lamar-Dixon wastewater treatment plant.

The disposal site will provide all shipping documents required for disposal of this material to the parish.
