Sealed bids will be accepted by the Ascension Parish Sheriff’s Department for the following:

Unleaded (Branded) gasoline, minimum of 87 octane to be purchased at retail outlets on the  east side and west side of the Mississippi River in Ascension Parish.

Fuel purchased shall be provided through a Vehicle Fleet Management System.

Bidder shall provide a secure fuel card which may be used throughout Ascension Parish with no initial card fees or card replacement fees.

Bidder will insure that commercial fueling stations are spread throughout Ascension Parish with at least one site open 24 hours per day in each of the following geographic areas on the east side of the Mississippi River:

North of La. 621 and West of U.S. 61

North of La. 621 and East of U.S. 61

South of La. 621 and West of U.S. 61

Each bid shall be for the contractual period July 1, 2012 through June 30, 2013.  Bid price shall be based on a cost-plus method.  Ascension Parish Sheriff’s Department acknowledges that cost will fluctuate, but the margin shall remain constant throughout the contractual term.

Bidder shall provide documentation of increases or decreases in rack price on a daily basis to support prices changes.  In the case where OPIS is used, bidder shall supply OPIS report on a regular basis.

Request for Proposals

Regenerative Air Street Sweeper and Chassis

The City of Gonzales will accept proposals on one (1) Regenerative Air Street Sweeper with the following specifications:

Street Sweeper shall have hydraulic drives, 4.5 cubic yard hopper, and 80” wide pickup head.  The head must be capable of sweeping in reverse with the head down without causing damage to the pickup head or its components.  The unit must be equipped with vertical digger-type gutter brooms, pressurized dust control spray system and an independent engine to power the sweeping functions.  The chassis for this sweeper is to be sufficiently rated to transport a full load of sweeping debris at speeds up to 55 MPH.  The chassis shall be equipped with spring suspension, dual steering, dual operator controls, and an automatic transmission.  All tires shall be the same size and have dual tires on each side of the rear axle (six-wheel configuration).  An auxiliary diesel engine shall be provided to power the sweeper.

Hydraulic power shall be used to operate all broom rotation and lifting functions of the sweeper.  All functions shall operate independently of each other with their own in-cab controls to include separate controls for each gutter broom.  Systems incorporating pneumatic-type controls will not be accepted. Hydraulic pressure shall not exceed 2,250 PSI.

Separation of the dirt and refuse from the air stream shall be accomplished within the hopper by means of a circular centrifugal dust separator.  The dust separator shall be designed so that it will not plug with normally encountered debris. Dust separation filters will not be accepted due to them clogging, the cost of replacement, and cleaning.

The volumetric capacity of the hopper shall not be less than 4.3 cubic yards.  Hopper roof shall include a hinged door allowing access for washout of the screen.  This door shall be in addition to the dump door.  Dump door shall be constructed from steel and be opened and closed hydraulically with dual hydraulic cylinders.  One in-cab switch shall open and close the rear door as well as raise and lower the hopper.

Heavy-duty steel blower shall be used to create air pressure and suction (regenerative air) for removing debris from road surface.  Sweepers that clean road surface by using suction only (pure vacuum) will not be accepted.

Sweeper shall have Sweeps-in-Reverse which allows it to sweep in both forward and reverse with the head down without causing damage to the head or other components.  NO EXCEPTIONS.  Sweeping heads that are not designed to sweep-in-reverse and that require add-on devices such as chains added to the head to meet this requirement will not be considered

Gutter brooms shall be hydraulic motor driven and shall be positioned laterally and vertically by hydraulic cylinders.  Each gutter broom shall have lateral flexibility to swing rearward 12” under the chassis when encountering the impact of an immovable object thus avoiding damage to the broom assembly.

Water spray shall be supplied by a electrically driven diaphragm type water pump.  The water pump to produce a minimum of 100 PSI with a minimum of 5.88GPM.  The water pump to automatically disengage when the water supply is depleted.

Sweeper shall have auxiliary hand hose for cleaning remote areas inaccessible to the sweeping head and for cleaning out catch basins.    

Sweeper shall meet all federal motor vehicle safety standards.    

Per manufactures published warranty, sweeper shall be warranted to be free of defective materials and workmanship for a period of 12 months or 1,200 hours from date of delivery.  No exceptions. Basic chassis warranty shall be 3 years/unlimited miles.  Chassis engine warranty shall be 3 years/unlimited miles.  Transmission warranty shall be 3 year/unlimited miles.

The unit shall be delivered completely assembled, serviced, and ready to operate.  The successful bidder shall have a qualified service representative in attendance with the sweeper during start up operations to make any adjustments needed and to give operator instruction on the proper operation and care of the sweeper.    The bidder shall supply a complete sweeper manual.

PURPOSE:

To amend the Ascension Parish Code of Ordinances, Chapter 14 Offenses and Miscellaneous Provisions, Article III. Noise, Section 14-41 – 14-47, entirely, including additions.

WHEREAS: Ascension Parish is a local governmental subdivision as defined by Article VI, Section 44 of the Louisiana Constitution of 1974, and

WHEREAS:  Parish of Ascension is the governing and responsible body over Offenses and Miscellaneous Provisions.

       WHEREAS: Article VI of the Home Rule Charter of Ascension Parish, adopted May 4, 1993, identifies the process and manner in which to adopt ordinances regulating the laws of this parish, and

WHEREAS: The Code of Ordinances, Chapter 14, Article III, Section 14-41 – 14-47 was last amended on August 19, 2008.

NOW THEREFORE, BE IT ORDAINED by the Ascension Parish Governing Authority that the Code of Ordinances of Ascension Parish, Chapter 14 Offenses and Miscellaneous Provisions, Article III., Noise, Section 14-41 – 14-47, be amended as follows:

Sec. 14-41. Noises interfering with enjoyment of property or public peace and comfort.

It is the intent of the Parish Council to endeavor to provide citizens with an environment free from such excess sounds or noise as may jeopardize their health, welfare and safety, or degrade the quality of life.

For the purposes of this article:

Construction activities shall mean any and all activity incidental to the construction, erection, demolition, assembling, altering, installing or equipping of buildings, structures, roads or appurtenances thereto, including land clearing, grading, excavating and filling.

Construction equipment shall mean construction activity utilizing any equipment or devices such as, but not limited to, pile drivers, power shovels, derricks, hoist tractors, loaders, rollers, concrete hauling motor vehicles, pavement breakers, bulldozers, crawler-tractors, rotary drills and augers, cranes, ditchers, trenchers, scrapers, wagons, pumps, compressors, pneumatic power equipment, or other mechanical apparatus operated by fuel or electric power in the construction, repair or demolition of any building, structure, land, street, alley, waterways, or appurtenance thereto.

db(A) shall mean a measure of sound pressure level in decibels on the A-weighted scale.

Decibel meter shall mean an instrument to measure decibels which meets or exceeds American National Standards Institute (ANSI) section 1.4, 1971(r.1976) standards for type 2 special purpose meters.

Device shall mean any mechanism which is intended to produce or which actually produces sound when operated or handled.

Noise shall mean any sound which exceeds the prescribed decibel levels at a time and location described in the article.

Person shall mean and include any individual, corporation, association, partnership or limited partnership.

Property line shall mean the boundary line distinguishing ownership or the common wall of a townhouse, condominium or leased premises.

Residential district shall have the same meaning as in the Zoning Ordinance of the Parish, including rural districts, conservation districts, medium intensity residential districts, or any other residential district as authorized by the Parish Council.

Sound shall mean that which is or can be heard, or particularly a temporal and spatial oscillation in pressure, or other physical quality, in a medium with internal forces that cause compression and rarefaction of that medium and which propagates at finite speed to distant points.

Sound-amplifying equipment shall mean any machine or device for the amplification of the human voice, music or any other sound or noise.

Sec. 14-43. Loudspeakers and amplifiers.

(a) General Restriction. It shall be unlawful for any person to use, operate or permit to be used or operated any device, radio, musical instrument, television, phonograph, drum, sound-amplifying equipment or device which produces or reproduces sound either stationary or mobile, in such a manner so as to create any sounds or noise which exceeds seventy-five (75) db(A) during the hours of 6:00 a.m. until 9:00 p.m. or which exceed seventy (70) db(A) from 9:00 p.m. until 6:00 a.m. at any property line within a residential district or upon any public street or right-or-way within or bordering upon any residential district within the unincorporated limits of the Parish.

(b) Loud or raucous sounds or noises. It shall be unlawful for any person to willfully make, cause or continue any noise which disturbs the peace or quiet of any residential district and which exceeds seventy-five (75) db(A) during the hours of 6:00 a.m. until 9:00 p.m. or which exceeds seventy (70) db(A) from 9:00 p.m. until 6:00 a.m. at any property line within a residential district or upon any public street or right-of-way within, or bordering upon, any residential district within the unincorporated limits of the Parish.

(c) Responsibility for creation of noise. Any person creating any such sound or noise as described in this section and/or anyone permitting such a sound or noise to be created in, or emanate from, any premises under his care, custody or control shall be presumed responsible for any such sound or noise.

Sec. 14-44. Variances and exceptions.

(a) Emergency and public work. Noise or sound created in the performance of public service by governmental agencies or their contractors; or emergency work engaged in by persons for the public safety, health or welfare; or to restore property to a safe condition following a public emergency; or work to restore essential public services, including construction activities directly related to the abatement of any emergency, shall not be subject to the provisions of this article.

(b) Noises from authorized activities. The prohibitions of this article shall not apply to air traffic at airports, parades, cultural event, athletic games, state or county fairs, or functions conducted pursuant to a permit specifically approved by the Parish of Ascension or other appropriate governmental agency. Issuance of a business license shall not constitute approval of, or authorization by the Parish council within the meaning of this section.

(c) Sirens, horns and whistles. The provisions of this article shall not apply to any siren, whistle, horn or bell used by emergency vehicles or civil defense or used by motor vehicles, trains and boats as warning devices to avoid collisions.

(d) Bells or chimes. The provisions of this article shall not apply to any bell or chimes, or any device for the production or reproduction of the sound thereof which are associated with a clock or time-keeping device, a church or school.

(e) Burglar alarms. The provisions of this article shall not apply to any burglar alarm or security device; provided, however, no burglar alarm or security device shall sound for more than fifteen (15) minutes after being activated.

(f) Construction activity or equipment. The provisions of this article shall not apply to any construction activity or equipment operated between the hours of 6:00 a.m. to 9:00 p.m.

(g) Domestic power equipment. The provisions of this article shall not apply to any domestic power equipment operated between the hours of 6:00 a.m. to 9:00 p.m.

(h) Vessels. The provisions of this article shall not apply to the operation of any motor boat or vessel on any lake, river, stream or waterway.

(i) Motor vehicles and trains. The provisions of this article shall not apply to the normal and usual operation of motor vehicles and trains.

Sec. 14-45. Penalties.

It shall be unlawful for any person to use, operate, or permit to be used or operated in a motor vehicle any sound-amplifying equipment, including, but not limited to, radios, compact disc players and cassette tape players which produces or reproduces sound in such a manner as to create any sounds or noise which exceeds seventy-five (75) db(A) on any public street or right-of-way in Ascension Parish which are not incorporated into the city limits of Gonzales, Donaldsonville, Sorrento, those areas being specifically covered by their respective municipal ordinance.

Sec. 14-46. Variances

(a) Variance permit.

(1) The parish council shall have the authority, consistent with this section, to grant special variances which may be requested when it finds or determines that:

a. Strict conformance with the provisions of this article would cause a hardship upon any person; or

b. The offending noise will be for a short duration and compliance with this article will be impractical; or

c. The benefit in the community of the activity creating the offending noise is greater than the adverse effect on the community of the noise created; or

d. The applicant needs additional time to modify equipment or take other action in order to comply with the provisions of this article.

(2) Notice of an application for a variance granted under this section shall be published in the same manner as provided for notice of ordinances in Ascension Parish, and shall be granted only after the matter is considered in a hearing at a regularly scheduled council meeting.

(3) The sheriff of Ascension Parish may grant an application for a variance (as) a temporary permit to exceed levels established herein until action is taken by the parish council on the application for a variance.

(4) Special variances shall be granted by notice to the applicant containing all necessary conditions, including a time limit on the permitted activity. The special variance shall not become effective until all conditions are agreed to by applicant. Noncompliance with any condition of a special variance shall terminate it and subject the person holding it to those provisions of this ordinance regulating the source of sound or activity for which the special variance was granted. Application for extension of time limits specified in special variances or for modification of other substantial conditions shall be treated like applications for initial variances.

Sec. 14-47. Administrative Adjudication - Penalties.

Violation of these Sections shall be adjudicated under the provisions of Article VIII., Code Enforcement by Administrative Adjudication of the Ascension Parish Code of Ordinances.

SEVERABILITY:  In the event that any portion of this Ordinance is ever held invalid or unconstitutional for any reason by any court of competent jurisdiction over it, such portion shall be deemed a separate, distinct, and independent provisions and shall not affect the validity of the remaining portions of the Ordinance.

EFFECTIVE DATE:  This ordinance shall be in full effect as permitted by law.

A.    The Commission shall apply the following rules in evaluation of subdivision applications.

a.    Density restrictions: considering any proposed major or minor subdivision which exist on any street which is less than 18 feet wide of asphalt, concrete or other hard surface, the developer shall secure a sixty (60) foot right of way along the street from his development to a street designated by the Department of Public Works in and for the Parish of Ascension, Engineering Review Agency and approval of the Parish Planning and Zoning Commission.

6. The exchange of land between owners of adjacent property provided that such exchange does not serve to reduce lot area or other dimensions below required minimums.

Attorney Jeff Diez explained a settlement agreement between the school board and Darby Architects regarding black mold at the new eight classroom building addition at Galvez Primary School.  On a motion by Mr. Gautreau and seconded by Mrs. Davis, the board unanimously approved a settlement agreement in the amount of $117, 500.00 between the Ascension Parish School Board and Darby Architects. (Attachment A)

Mrs. Lou Ann Bishop said that eleven Ascension Parish students won at the regional science fair and went on to compete at the state level.  She was honored to recognize the following winner at the recent Louisiana State Science Fair.

Mrs. Bishop also recognized Sannihith’s father who was in the audience.  Sannihith explained his project to the audience.

Mrs. Stafford said that back in the day special needs students were not taught in the regular classroom.  Today we have inclusion classes which include regular and special needs students.  The Office of Disability Affairs started offering an Inclusive Schools Art Contest.  This year’s theme was “Inclusion:  Building a Brighter Future Together”.  Mrs. Stafford was excited to announce that one of our students recently placed third at the State level and will be recognized by the Governor.  Shea Woodring, teacher, accepted the award on behalf of the student who was unable to attend the meeting.

All together Ascension Parish had 67 Blue Ribbons and Gold Medals.  Mrs. Vaughn congratulated all of the athletes and thanked the parents, volunteers, and coaches who go above and beyond to help train the athletes.  She wished those athletes participating in the state games good luck.

Mrs. Pujol said that the Personnel Committee held interviews for the Assistant Principal position at St. Amant High School.  It was her honor to recommend Mr. Prince Gray as Assistant Principal at St. Amant High School.  On a motion by Mr. Bourgeois and seconded by Mrs. Wimberly, the board unanimously approved the above recommendation.

Mr. Gray thanked Mrs. Pujol, board members and stakeholders of Ascension Parish for this honor and humbling experience to be trusted with the children of this parish.  He will work with the staff to give our children the best.  He will be steadfast in his resolve to be part of this St. Amant High team to continue to give the children of St. Amant High School the best education possible.

Mrs. Russo said that the Child Nutrition Committee met on May 10, 2012.  The only item on the agenda was discussion of the proposed 2012-2013 Child Nutrition Budget.  Ms. Johnson reported that estimates show a small increase in revenues, but also an increase in expenses, mainly due to salary and benefits and an increase in food costs.  An estimated $600,000.00 deficit is expected for the next school year, which is a $300,000.00 decrease from last year.  Mrs. Russo commended Ms. Johnson for doing an excellent job.

Mr. Kleinpeter scheduled an Athletic Committee Meeting for Tuesday, June 19, at 5:30 P.M.

Mr. Murphy scheduled an Insurance Committee Meeting for Tuesday, June 5, at 6:00 P.M.

Under Superintendent’s Comments, Mrs. Pujol noted the following:

Scores on LEAP and ILEAP will be out on Friday.  She will send an e-mail once they have been analyzed.

PERMIT

The LDEQ, Office of Environmental Services, is accepting written comments on a  Louisiana Pollutant Discharge Elimination System (LPDES) permit prepared for Sea Port Services, LLC, 226 Eastbank Street, Gonzales, Louisiana 70737.  The facility is operating between River Miles 1 to 234 on the Mississippi River, in Plaquemines, Orleans, St. Charles, St. John the Baptist, St. James, St. Bernard, Jefferson, Iberville, Ascension, East Baton Rouge and West Baton Rouge Parishes.

The principal discharge from this  source  made into the Mississippi River, waters of the state classified for primary contact recreation, secondary contact recreation, propagation of fish and wildlife and drinking water supply.  Under the SIC  4491, the applicant proposes to discharge dry commodity barge/vessel washwater and coal and coke barge/vessel washwater from a proposed barge cleaning facility.

During the preparation of this permit, it has been determined that the discharge will have no adverse impact on the existing uses of the receiving waterbody.  As with any discharge, however, some change in existing water quality may occur.

Comments and requests for a public hearing or notification of the final decision can be submitted via personal delivery, U.S. mail, email, or fax.  Comments and  requests for public hearings must be received by 4:30 pm CST, Monday, July 23, 2012.  Delivery may be made to the drop-box at 602 N. 5th St., Baton Rouge, LA 70802.  U.S. Mail may be sent to LDEQ, Public Participation Group, P.O. COMMISSIONERS MEETING

The Meeting of the East Ascension Consolidated Gravity Drainage District 1 Commission Meeting was held on Monday, May 7, 2012 at 6:15 P. M. in the Council Meeting Room, Courthouse Annex, Gonzales, Louisiana.

Chairman Randy Clouatre called the meeting to order.

The invocation was given by Chris Loar and the Pledge of Allegiance was recited by all present.

Mr. Bill Roux addressed the rain event on May 2, 2012.  Additional comments and questions were made by Commission Members and Parish President Tommy Martinez.  There was a discussion.  

Agenda item #6 – Drainage Report

Mr. Jake Lambert of GSA inc. gave an update on the Laurel Ridge Levee Project.  There was a brief discussion.

Agenda item #7 – Acceptance of lowest responsive bid for used steel welded barge    

A motion was made by Todd Lambert and seconded by Kent Schexnaydre to approve the recommendation of the Purchasing Department and EAD accepting the lowest responsive bid from Maintenance Services, INC. for a used steel welded utility barge in the amount of $15,000.00 and to authorize the Parish President to enter into any applicable agreement or contract for this project.  No objection.  Motion carried.

Agenda item #8 – Renewal of Contract for 2012 – JAT Trucking –Contract Dirt Hauling List

A motion was made by Todd Lambert and seconded by Dempsey Lambert to add JAT trucking to the list of approved dirt hauling with EAD.  No objections.  Motion carried.
