ADVERTISEMENT FOR BIDS

Sealed bids will be received by the Ascension Parish Government Purchasing Department, 120 East Railroad Street, Gonzales, Louisiana 70737 (mailing P.O. Bids shall be addressed to the Ascension Parish Purchasing Department, and delivered to the Parish Office located at 120 East Railroad Street, Gonzales, LA  70737 not later than 10:00 a.m., on the 6th day of March 2012, at which time the bids will be publicly opened and real aloud.    Bids must be submitted on the proper bid form.  Each bid shall be enclosed in a sealed envelope showing the name, address, and license number of the bidder.  Any bid received after the specified time and date will not be considered.  

The Bidding Documents (including construction drawings and specifications) may be examined at the Owner’s office located at 120 East Railroad Street, Gonzales, LA  70737 or at the office of the engineer, Professional Engineering Consultants Corporation, located at 7600 GSRI Avenue, Baton Rouge, Louisiana 70820.  

Copies of the bidding documents may be obtained at the engineer’s office located at 7600 GSRI Avenue, Baton Rouge, Louisiana 70820 upon deposit of $150.00 for each complete set.  Plans and specifications will be available until twenty-four (24) hours before the bid opening.  In accordance with Louisiana R.S. 38:2212, deposits on the first set of documents furnished to bona fide prime bidders will be fully refunded upon return of the documents no later than ten (10) days after receipt of bids.  On other sets of documents furnished to bidders, the deposit less the actual cost of reproduction will be refunded upon return of the documents no later than ten (10) days after receipt of bids.

A MANDATORY Pre-Bid Conference which will be held on February 15, 2012 at 09:30 a.m., at the Ascension Parish Courthouse, Executive Conference Room, 2nd Floor, 828 S. Irma Blvd., Gonzales, LA 70737.  

The Owner requires that each bidder attach to his bid a certified check, cashier’s check, or bid bond equivalent to 5% of the total bid as evidence of good faith of the bidder.  Sureties used for obtaining bonds must appear as acceptable on the U.S. Department of the Treasury Circular 570.

No bidder may withdraw his bid within forty-five (45) days after the actual date of the opening thereof except as provided by law.

The attention of bidders is called particularly to the requirements for conditions of employment to be observed and minimum wage rates to be paid under the Contract, Section 3, Segregated Facilities, Section 109, Executive Order 11246, and all applicable laws and regulations of the Federal Government and State of Louisiana and bonding and insurance requirements.

Any person with disabilities requiring special accommodations must contact the Parish of Ascension no later than seven (7) days prior to the bid opening.

PUBLIC NOTICE

The Ascension-St. James Airport and Transportation Authority will  be accepting Sealed Bids until 11:00 a.m. February 27, 2012 for the following services to be provided at Louisiana Regional Airport.

1) Grooming Contract: includes the groom cutting of approximately 12.5 acres and weed control around navigational lights, asphalt pavements and the automobile parking lot.

2) Bush Hog Contract: includes bush hogging of  approximately 52.5 acres.

3) Bids will be accepted for a 3 year term hay bailing lease of approximately 53 acres.

Interested vendors may bid on multiple contracts; however, each service must be bid separately.  Bid packages are to be picked up from the Airport Administration Office by 11:00 am on February 24, 2011. To schedule a time to pick-up the bid package contact Janet Gonzales at 225-717-2077.

STATEMENT OF WORK:

This project consists of Electrical  and Structural improvements to light fixtures and lighting standards at Netter Field, Mistretta Field, Lemann Field, 290 Softball Field and La La Regira Field, as shown and descried in the Contract Documents.

All Bids must be in accordance with the Contract Documents on file at the Ascension Parish Purchasing Department 120 East Railroad Street, Gonzales, Louisiana, 70707-1659.

Copies of Specifications and Construction Drawings for use in preparing Bids may be obtained from Lucien T. Vivien, Jr. & Associates, Inc 3001 22nd St, Metairie, LA  70002; 504-218-5409 with a deposit of One Hundred Fifty Dollars ($150.00) per set via check made payable to Lucien T. Vivien, Jr. & Associates, Inc, (Please allow 24 hour notice prior to pick-up of documents).  Documents can be mailed, USPS ground, to Contractor for an additional cost of $15.  Upon return of documents no later than 10 days after bids a full refund will be made for returned drawings in good condition.

Where bids are to be received on forms furnished by the awarding authority, no contract documents shall be issued to anyone except a Licensed Contractor or his authorized Representatives.  In no event shall any documents for bidding be issued later than twenty-four (24) hours prior to the hour and date set for receiving bids.

Each bid must be submitted in a sealed envelope bearing on the outside the name of the bidder, his/her address, contractor’s state license number and the name of the project for which the bid is submitted.  If forwarded by mail, the sealed envelope containing the bid must be enclosed in another envelope addressed to the Ascension Parish Purchasing Department, 120 East Railroad Street, Gonzales, Louisiana (P.O. Request for Scenic River Permit on Bayou Manchac

The Secretary of the Louisiana Department of Wildlife and Fisheries as Administrator of the Louisiana Natural and Scenic Rivers System is currently considering the application of Marcus Ledoux for a permit to build a camp and boat dock on Bayou Manchac.  The decision to grant or deny this permit in the public interest will be based on an evaluation of the probable impacts of the proposed activity on Bayou Manchac.

Copies of the application can be seen by the public at the Department of Wildlife and Fisheries main office, Room 432, 2000 Quail Drive, Baton Rouge, LA.  The public is invited to comment on this permit request  for a period of forty-five (45) days.  Responses should convey sound reasoning for or against the proposal and be mailed to Scenic Rivers Program, LDWF, P.O. Special Election-Town of Sorrento

WHEREAS, there has been declared a vacancy on the Town Council of the Town of Sorrento as of January 26, 2012 due to the resignation of Councilman Lionel Melancon, Jr.; and

WHEREAS, state law requires that the governing authority for the Town of Sorrento issue a proclamation ordering a special election to fill the vacancy of the Councilman of Sorrento.

WHEREAS, a meeting of the Town Council was held on the 6th day of February, 2012, in which the following proclamation was issued:

IT IS HEREBY PROCLAIMED that a special election is ordered to fill the vacancy of the Councilman for the Town of Sorrento.  The open primary for this special election will take place on November 6, 2012.  Qualifying period for candidates seeking to fill the vacancy will be held August 15, 16, and 17, 2012.  A general election, if necessary, will be held on December 1, 2012.

      IN WITNESS WHEREOF, I have hereunto set my hand and caused to be affixed the official seal of the Town of Sorrento on this 6th day of February, 2012.

The Occidental Chemical Corporation Geismar Facility (OxyChem-Geismar) recently submitted to the Louisiana Department of Environmental Quality-Permits Division, Class 1 Permit Modifications to the facility’s Hazardous Waste Operating Permit (LAD 092681824-OP-RN-1) issued on November 9, 2009.  A Class 1 Permit Modification is the most minor form of permit modification.

Periodic updates to the emergency coordinator information list were submitted in November 2011, and minor changes and updates to the Hazardous Waste Contingency Plan were submitted in February 2012.  These modifications will not change or alter any hazardous waste operations at the facility.

This public notice is being provided to all persons on the facility mailing list and appropriate units of state and local governments in accordance with LAC 33:V.321.C.1.a.ii.  A copy of OxyChem-Geismar’s Hazardous Waste Permit Class 1 Modification can be viewed at the Department of Environmental Quality, 602 North 5th Street, Baton Rouge, Louisiana.

Agenda Item #8 – Authorization to pay CDM and & Amend Contract for inspection services – NRCS Debris Removal Project, SRS Contractor

A motion was made by Todd Lambert and seconded by Adrian Thompson to authorize amending the contract between CDM and EA Drainage District #1 for professional services on the NRCS Waterway Debris Removal Project of 2010 to increase the total contract compensation to $121,784.93, and increase of $28,231.93 for reimbursement of inspection services.  No objections.  Motion carried.  

Agenda Item #9 –Authorization to amend engineering contract –BKI- Marvin Braud Pump Station Expansion Project-Evaluation and recommendations for Repair & Upgrade of existing Pump Bays, Rakes and Engine Coolers

A motion was made by Dempsey Lambert and seconded by Todd Lambert to authorize amending the contract between BKI and EA Drainage District #1 for engineering on the Marvin Braud Pump Station Expansion Project to include evaluation and recommendations for repairs and upgrades of existing pump bays, rakes and engine coolers at a cost not to exceed $74,608.00.

STAFF COMMENTS

Requested Variance:

Ascension Parish Land Use Plan Statement:

(1) The granting of the variance shall be in harmony with the general purpose which it is located and shall not be injurious to the neighborhood or otherwise detrimental to the public welfare.

(2) The granting of the variance will not permit the establishment of any use, which is not permitted in the district.

(3) There must be a showing of unique circumstances.

Commentary:  There must exist special circumstances or conditions, fully described in the findings, applicable to the land or buildings for which the variance is sought, which circumstances or conditions are peculiar to such land or buildings and do not apply generally to land or buildings in the neighborhood, and which circumstances or conditions are such that the strict application of the provisions

 (4) There must be a showing of unnecessary hardship.

Commentary: It is not sufficient proof of hardship to show that greater profit would result if the variance were granted.  Furthermore, the hardship complained of cannot be self-created; nor can it be established on this basis by one who purchases with or without knowledge of the restrictions; it must result from the application of this ordinance; it must be suffered directly by the property in question; and evidence of variance granted under similar circumstances shall not be considered.

(5) There must be a showing that a variance is necessary for the reasonable use of the land or building and that the variance as granted by the board is the minimum variance that will accomplish this purpose.

(6) There must be a showing that the proposed variance will not impair an adequate supply of light and air to adjacent property, substantially increase the congestion in the public streets, increase the danger of fire, endanger the public safety, or substantially diminish or impair property values within the adjacent neighborhood.

(7) There must be a showing that the granting of the variance requested would not confer on the applicant any special privilege that is denied by this ordinance to other lands, structures, or buildings in the same district.  The Board may prescribe any safeguard that it deems necessary to secure substantially the objectives of the regulations or provisions to which the variance applies.

Requested Variance:

Ascension Parish Land Use Plan Statement:

(1) The granting of the variance shall be in harmony with the general purpose which it is located and shall not be injurious to the neighborhood or otherwise detrimental to the public welfare.

(2) The granting of the variance will not permit the establishment of any use, which is not permitted in the district.

(3) There must be a showing of unique circumstances.

Commentary:  There must exist special circumstances or conditions, fully described in the findings, applicable to the land or buildings for which the variance is sought, which circumstances or conditions are peculiar to such land or buildings and do not apply generally to land or buildings in the neighborhood, and which circumstances or conditions are such that the strict application of the provisions

(4) There must be a showing of unnecessary hardship.

Commentary: It is not sufficient proof of hardship to show that greater profit would result if the variance were granted.  Furthermore, the hardship complained of cannot be self-created; nor can it be established on this basis by one who purchases with or without knowledge of the restrictions; it must result from the application of this ordinance; it must be suffered directly by the property in question; and evidence of variance granted under similar circumstances shall not be considered.

(5) There must be a showing that a variance is necessary for the reasonable use of the land or building and that the variance as granted by the board is the minimum variance that will accomplish this purpose.

(6) There must be a showing that the proposed variance will not impair an adequate supply of light and air to adjacent property, substantially increase the congestion in the public streets, increase the danger of fire, endanger the public safety, or substantially diminish or impair property values within the adjacent neighborhood.

(7) There must be a showing that the granting of the variance requested would not confer on the applicant any special privilege that is denied by this ordinance to other lands, structures, or buildings in the same district.  The Board may prescribe any safeguard that it deems necessary to secure substantially the objectives of the regulations or provisions to which the variance applies.

The Council of the Parish of Ascension, Louisiana, met in regular session on Thursday, January 19, 2012 6:00 p.m., in the Ascension Parish Courthouse 828 S. Irma Blvd., Gonzales, Louisiana with Chairman Chris Loar.

The opening prayer was offered by Reverend Mark Ellis.  

The pledge was led and signed by the second grade class from Oak Grove Elementary.

The following Council members were present:

Parish President Tommy Martinez was also present.

Parish President Tommy Martinez presented Certificates of Achievement to Coach Kenny Almond who recently surpassed 800 career wins as East Ascension High School Boys Basketball Team and to Coach Gary Duhe for recently surpassing 700 career wins as head coach of the St. Amant High Boys Basketball Team.

President Martinez and the Council also honored Mr. Mike Braud, a volunteer firefighter who recently saved the lives of community members caught in a trailer fire.

On a motion by Councilman Todd Lambert and a second Councilman Kent Schexnaydre the Council adopted the “CONSENT AGENDA” as follows:

    Councilman Satterlee made a substitute motion to correct a typo in the December 19, 2011 minutes whereby Councilman Chris Loar’s name was listed twice and Councilman Satterlee’s name was omitted. The substitute motion passed on a second by Councilman Oliver Joseph. Councilman Satterlee also recused himself from items 7a and 7b on the Consent Agenda.

Chairman Loar asked for a motion to move t he February 2, 2012 Regular Council Meeting to February 7, 2012 in order to accommodate time limits of seating a new Planning and Zoning Commission. The motion was made by Councilman Benny Johnson and seconded by Councilman Dempsey Lambert. The motion passed unanimously.

After some discussion, a motion was made by Councilman Randy Clouatre to send a Resolution to the Capital Area Expressway Authority in opposition to the Southern Baton Rouge Loop. This motion was seconded by Councilman Todd Lambert. Councilman Kent Schexnaydre made an amended motion to add in the resolution support of the Westbank Expressway connecting the three bridges. The amended motion was seconded by Councilman Oliver Joseph. The motion passed with no objection. President Martinez asked that his name be added to the Resolution.

Mr. Garney Gautreau, Recreation Director presented the Certificate of Substantial Completion for the Ascension Parish Skate Park – Phase I.  The Certificate of Substantial Completion was unanimously approved on a motion by Councilman Todd Lambert and a second by Councilman Bryan Melancon.

Mr. Lavern Bourgeois, Chief Building Official presented the Condemnation Proceedings for 38032 Highway 621. A motion to condemn was made by Councilman Satterlee and seconded by Councilman Schexnaydre. The motion passed with no objection. After more discussion, Mr. Bourgeois confirmed that the condemnation would give the owner thirty days to take care of things on their own.

Ben Laurie, Engineer, asked the Council for approval of a Certificate of Substantial Completion for the Intersection Improvements Project – Phase II-B (US HWY 61 at HWY 621 and at AP HWY 929) with Expert Maintenance.  The motion to approve was made by Councilman Joseph and seconded by Councilman Benny Johnson. No objections were made. The motion passed.

Ms. Joan Shivers, Purchasing Manager presented the Request for Qualifications – Architectural Design for a Prototype Fire Station. She reported that there were 12 proposals and that the Professional Selection Committee recommended accepting the qualification statement submitted by Domangue Designs and to authorize the Parish President to begin contract negotiations for this service. The approval was uaninimous on a motion by Councilman Todd Lambert and a second by Councilwoman Teri Casso.

There being no further business to come before the Council of the Parish of Ascension, Louisiana, upon motion duly made and seconded, the meeting adjourned at 6:47 PM.

  ORDINANCE    

Purpose:  

To declare a 1997 Freightliner/Ferrara pumper as surplus and transfer title pursuant to a Cooperative Endeavor Agreement attached hereto and made a part hereof.

WHEREAS, the Ascension Parish Government, Fire Protection District #1 owns a 1997 Freightliner/Ferrara pumper bearing VIN 1FV6JLCB9VH838529, that is surplus equipment and is no longer needed by the Parish,

WHEREAS, the Town of Sorrento has need for this equipment.

THEREFORE BE IT ORDAINED that the Ascension Parish Council, as the governing authority in and for the Parish of Ascension does hereby declare the aforementioned vehicle to be surplus and authorize the conveyance and transfer of all rights, title and interest in one 1997 Freightliner/Ferrara pumper bearing vehicle identification number 1FV6JLCB9VH838529 to the Town of Sorrento as is, and without warranty of any kind for the terms and conditions as set forth in the Cooperative Endeavor Agreement attached hereto and made a part hereof.

This ordinance having been submitted to a vote, the vote thereon was as follows:

NOTICE OF A PUBLIC HEARING

NOTICE IS HEREBY GIVEN, that the Zoning Commission of the City of Gonzales will hold a Public Hearing on March 5, 2012 at 6:00 P.M. in the conference room at city hall to consider the request of N.A “Sonny” Lamendola to rezone the following described property from its existing R-15 zone to an I-1 zone:

A certain piece of property situated on the north side of W. Orice Roth Street, beginning at a point approximately 402.31 feet west of the intersection of W. Orice Roth Street and S. Darla Ave., then proceeding west approximately 2,243.85 feet, then north approximately 1293.53 feet, then east approximately 1,518.70 feet, then in a sourtheasterly direction along the existing pipeline right of way to the point of origin.
