Notice Issued:  January 12, 2012

On or about January 20,2012, the Ascension Parish Government (APG) will submit a request to the Louisiana Office of Community Development (OCD) for the release of funds under the FY 2008 Consolidated Security, Disaster Assistance and Continuing Appropriation Act, 2009 (PL 110-329), in accordance with the “Notice of Funding Availability” published in the Federal Register on February 13, 2009, for the rehabilitation of the Sorrento Sewage Treatment Plant ponds to restore original treatment capacity located approximately 500 feet south of Bertrand Street in Sorrento, Ascension Parish, LA. The total CDBG assistance for this activity is $500,000.

The activity proposed is Categorically Excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act requirements. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at the APG Grants Office, 122 E. Railroad Avenue, Gonzales, LA  70737, (225) 621-1128 and may be examined or copied weekdays 7:30 a.m. to 5 p.m (Monday – Thursday) and 7:30 a.m. to 11:30 a.m. (Friday).

PUBLIC COMMENTS:  Any individual, group, or agency disagreeing with this determination, or wishing to comment on the project may submit written comments to this office. All comments received by January 19, 2012 will be considered by this office prior to authorizing submission of a request for release of funds. Commenters should specify which part of this Notice they are addressing.

RELEASE OF FUNDS:  This Office certifies to HUD that Tommy Martinez, in his capacity as Parish President, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied.  OCD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the APG to use HUD Program Funds

OBJECTIONS TO RELEASE OF FUNDS.  The OCD will accept objections to its release of funds and APG’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases:  (a) the certification was not executed by the Certifying Officer of APG approved by HUD; (b) APG has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the project have committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.  Objections must be prepared and submitted in accordance with the required procedures (24 CFR part 58, sec. 58.76) and shall be addressed to:

The LDEQ, Office of Environmental Services, is accepting written comments on a  Louisiana Pollutant Discharge Elimination System (LPDES) permit prepared for Impala Warehousing (US) LLC, Burnside Terminal, 4258 Highway 44, Burnside, LA 70725.  The facility is located at 4258 Highway 44, in Burnside, Ascension Parish.  Upon the effective date of the final permit, the LPDES permit shall replace the previously issued LPDES permit, LAG531147.

The principal discharge from this  source  made into the Mississippi River (Outfall 001) and local drainage thence to Conway Canal; thence to Panama Canal (Outfall 002), waters of the state classified for primary contact recreation, secondary contact recreation, propagation of fish and wildlife, and drinking water supply (Mississippi River only).  Under the SIC  4491, the applicant proposes to discharge treated sanitary wastewater, dock washdown, utility washwater, exterior vehicle and equipment washwater, and industrial stormwater runoff from a proposed bulk marine terminal.

During the preparation of this permit, it has been determined that the discharge will have no adverse impact on the existing uses of the receiving waterbody.  As with any discharge, however, some change in existing water quality may occur.

The Ascension Parish School Board met in regular session on Tuesday, December 6, 2011 at 6:30 P.M. in the School Board Office, Donaldsonville, Louisiana.  Mr. Edward Price, President, presided.

On roll call the following members were in attendance:

Ms. Meredith Hathorn, Foley & Judell Lawyer, explained a resolution for the opening of bids for the purchase of $20,000,000 of General Obligation School Bonds.  There is an electronic platform in her office in New Orleans in which they are watching the bids come in.  A fax will be received very shortly.  Five eligible bidders qualify today so they are expecting to have a very competitive sale tonight.  It was moved by Mr. Nickens and seconded by Mrs. Davis to adopt a resolution providing for the opening and tabulation of the sealed and electronic bids received for the purchase of $20,000,000 of general obligation school bonds, series 2012, of the parish-wide school district of Ascension Parish, Louisiana, approving the official notice of bond sale and official statement in connection therewith.  (Attachment A) The following vote was taken:

Mr. Eric Kehn, President of Ascension Parish A+PEL Chapter thanked the board for allowing him and Ms. Suzanne Harris, Executive Director of A+PEL, the opportunity to present awards to the following recipients of very competitive grants:

Mrs. Wimberly spoke of a meeting with the parish officials who were supporting Relay for Life.  The Parish President declared the month of April as Cancer Awareness month. Ms. Wimberly thought it would be an honor to pass a resolution supporting Relay for Life and then called on Ms. Devon McDonel, Associate Executive Director of the Baton Rouge branch of American Cancer Society who discussed the organization and its mission. It was moved by Mrs. Wimberly and seconded by Mr. Nickens to approve a resolution in support of Relay for Life and the American Cancer Society. (Attachment C) The following vote was taken:

At this time Mr. Price said that this could possibly be his last official meeting.  This is a bittersweet time of his life.  He has sent a letter to the Secretary of State resigning effective January 8, 2012 after 27 years of service to Ascension Parish School Board.  He worked well with five Superintendents and numerous board members and it has been great. This parish has worked hard at putting the children first and will continue to do so.  Mr. Price thanked everyone for their support in his effort to be elected as State Representative.  He could not say “thank you” enough to everyone.  Mr. Price received a standing ovation from the audience.

At this time the board returned to item G.  Ms. Meredith Hathorn, Foley & Judell Lawyer, said that the bids were received and requested that the board approve a resolution accepting the lowest and best bid received for the purchase of $20,000,000 of general obligation school bonds.  She noted that five bids were received with the low bidder being Bank of America with a TIC of 3.12%.  It was moved by Mrs. Russo and seconded by Mrs. Davis to adopt a resolution accepting the lowest and best bid received for the purchase of twenty million dollars ($20,000,000) of general obligation school bonds, series 2012, of the parish-wide school district of Ascension Parish, Louisiana, and providing for other matters in connection therewith. This action was conditioned upon putting a good faith deposit down tomorrow.  (Attachment E) The following vote was taken:

At this time the board returned to Item H.  It was moved by Mr. Murphy and seconded by Mr. Bourgeois to adopt a resolution authorizing the incurring of debt and issuance of twenty million dollars ($20,000,000) of general obligation school bonds, series 2012, of parish-wide school district of Ascension Parish, Louisiana; prescribing the form, terms and conditions of said bonds; designating the date, denomination and place of payment of said bonds; providing for the payment thereof in principal and interest; and providing for other matters in connection  therewith.  (Attachment F)  The following vote was taken:

Nickens be appointed President of the Board.  It was moved by Mr. Murphy and seconded by Mr. Diez that Mr. Troy Gautreau be appointed President of the Board.  Mr. Price asked to indicate by vote all in favor of appointing Mr. Nickens as President.  The following vote was taken:

There being a tie in the votes, Mr. Price scheduled a Special Meeting on January 3, 2012 specifically for Election of Officers of Ascension Parish School Board.

Under Committee Reports, Mr. Gautreau said that the Strategic Planning Committee met today.  The following report was given:

The committee was updated on the closing of MP Evans property on 10-27-11 and legal is working on a cooperative endeavor agreement with the sellers regarding extension of the existing agricultural use by existing third party.

The committee was updated on the progress of the Bullion infrastructure improvements. The improvements need to be complete by 2-12-2012 as per the purchase agreement.

The committee was updated that the negotiations of the Hanson property have resumed.

Mr. Duplechein presented some enrollment/population history trends and projections for high school enrollment and total enrollment.

Mike Buturla with Domain Design presented some drawings on the St. Amant High master plan that would include a freshman academy concept. The committee asks that staff continue to develop the freshman academy concept plans for East Ascension, Dutchtown High, and Donaldsonville High.

Under Superintendent’s Comments, Mrs. Pujol noted the following:

Congratulated everyone on the renewal of the 2.5 mil in the tax election.  This spoke highly of the community confidence of the work of the board and the school system.

We received notice today that the parish was awarded QSCB bonds in the amount of 1.46 million.

A resolution from Lafayette Parish School Board regarding Early Childhood Education for all Students is in packets.

Mrs. Pujol thanked Mr. Price for his many years of service to this parish and his leadership and selfless dedication to our school system.  We will miss him and wish him well in his new role.  She noted that the board has to appoint Mr. Price’s replacement within 10 days of his resignation which will be January 8, 2012.  Replacement for Mr. Price’s position will be on the January 10, agenda as well as the calling of a special election.

Mr. Price thanked Mrs. Pujol for her comments.

Under Board Comments, Mr. Nickens said it was a pleasure working with Mr. Price and wished him all the success.

Mrs. Russo said Mr. Price was a tremendous leader for the board and was thankful that he introduced her to LSBA.  She wished him the best of luck.

Mrs. Davis echoed what was said emphasizing his leadership for the parish and that Mr. Price is a friend of education which is what we need at the State Legislature.

Mrs. Wimberly congratulated Mr. Price and thanked the board for the support in her vice-presidency her first year.  She also thanked Mrs. Pujol and said she is looking forward to the next year.  We have a Superintendent who works with ideas from the board and put them into action.

As a new board member, Mr. Bourgeois congratulated Mr. Price and noted that he had heard a lot of good things about Mr. Price’s leadership.  Mr. Price has demonstrated that leadership.  Mr. Bourgeois thanked Mr. Price for the guidance provided to him.

Mr. Price thanked everyone for their comments.

There was no action under Action Item Review.

Under Item S.  Executive Session:  Appeal of Expulsion of B.B., Student at Dutchtown High School, Mr. Price asked if the parents were present.  The parents were present and choose to have the hearing in closed session.  It was moved by Mr. Gautreau and seconded by Mr. Nickens to go into executive session for 30 minutes.  In attendance were the parents and student, Principal-Ms. Edith Walker, School Board Attorney-Ms. Tonya Clark, School Board Members, Mrs. Pujol and Ms. Lamendola.  The following roll call vote was taken:

Mrs. Pujol informed the board that as a result of an audit at Donaldsonville High School there are some investigations that need to occur based on what our external auditor, Mr. Schexnayder, advised us.  A letter will be going out to the Legislative Auditor and the District Attorney informing them of some irregularities that we have seen in this audit.  We will ask them to do a full investigation.

Mr. Bourgeois scheduled a Facilities Management Committee meeting for January 10, 2012 at 5:30 P.M.
