PERMIT

The LDEQ, Office of Environmental Services, is accepting written comments on a  Louisiana Pollutant Discharge Elimination System (LPDES) permit prepared for Ports America Louisiana, LLC, Derrick Barge Fleet, 601 Louisiana Avenue, New Orleans, LA  70115.  The facility is located /operates between Head of Passes at River Mile 0 and River Mile 247 on the Mississippi River and various sites on the Industrial Canal, Harvey Canal, Intracoastal Waterway and other connecting commercial water transportation accesses along the Mississippi River in Plaquemines, Jefferson, St. Bernard, Orleans, St. Charles, St. John the Baptist, St. James, Ascension, Iberville, East Baton Rouge and West Baton Rouge Parishes.  Upon the effective date of the final permit, the LPDES permit shall replace the previously issued LPDES permit.

The principal discharge from this  source  made into the Mississippi River and various sites on the Industrial Canal, Harvey Canal, Intracoastal Waterway and other connecting commercial water transportation accesses along the Mississippi River , waters of the state classified for primary contact recreation, secondary contact recreation, propagation of fish and wildlife and drinking water supply (Mississippi River).  Under the SIC  4491, the applicant proposes to discharge maintenance ballast and void water, equipment/deck washdown water, and stormwater runoff from an existing derrick crane barge fleet/stevedoring operation.

During the preparation of this permit, it has been determined that the discharge will have no adverse impact on the existing uses of the receiving waterbody.  As with any discharge, however, some change in existing water quality may occur.

PUBLIC NOTICE

Louisiana Department of Environmental Quality

The Louisiana Department of Environmental Quality (LDEQ) will receive comments through November 7, 2011, regarding the draft Bayou Manchac Watershed Total Maximum Daily Load (TMDL) for chlorides, sulfates, and total dissolved solids.  Written comments must be received by LDEQ by 4:30 pm CST, on November 7, 2011.

Bayou Manchac is in the Lake Pontchartrain Basin and this study includes Water Quality Subsegment 040201 (Agency Interest Number 91256).  Bayou Manchac is located in south Louisiana and this subsegment includes Bayou Fountain, Ward Creek, Ward Creek Diversion Canal, Welsh Gully, Cotton Bayou, Muddy Creek, and several unnamed tributaries.  The subsegment lies in East Baton Rouge, Iberville and Ascension Parishes.

This TMDL will incorporate a phased approach.  Phase I includes the development of a TMDL for the current chlorides criterion of 25 mg/L, sulfates criterion of 10 mg/L and total dissolved solids criterion of 150 mg/L for Subsegment 040201.  LDEQ plans to evaluate the need to modify chlorides, sulfates and total dissolved solids criteria for Bayou Manchac (Subsegment 040201) through a planned use attainability analysis (UAA) study.  Once the evaluation is complete, and if needed, the chlorides, sulfates and total dissolved solids criteria for the subsegment has been revised, then Phase II will be completed.  Phase II will include revision and implementation of the TMDL for the appropriate chlorides, sulfates and total dissolved solids criteria.

This TMDL will be incorporated into Volume 3 of the Louisiana Water Quality Management Plan upon approval by the U.S. EPA.

NOTICE IS HEREBY GIVEN that the Co-Executors of the captioned succession have filed a Petition Filing Tableau of Distribution requesting court authority to pay debts, expenses and distribution of this succession in accordance with a Tableau of Distribution attached to said Petition.  The Petition and Tableau of Distribution can be homologated after the expiration of seven (7) days from the date of publication of this notice.  Any opposition to the Petition and/or Tableau of Distribution must be filed prior to homologation.  If no opposition is filed, the court may grant the authority requested at any time after the expiration of seven (7) days from the date of publication of this Notice.
