TURN SERVICES, LLC

TURN SERVICES MOBILE FACILITY

DRAFT WATER DISCHARGE PERMIT

The LDEQ, Office of Environmental Services, is accepting written comments on a draft Louisiana Pollutant Discharge Elimination System (LPDES) permit prepared for Turn Services LLC, Turn Services Mobile Facility, 3817 Chartres St.  The facility operates on the Mississippi River between mile marker 0 and 234 MAHP, in Plaquemines, St. Bernard, Orleans, Jefferson, St. Charles, St. John the Baptist, St. James, Assension,  East Baton Rouge, and West Baton Rouge Parishes.  Upon the effective date of the final permit, the LPDES permit shall replace the previously issued LPDES permit.

The principal discharge from this existing source is made into the Mississippi River, waters of the state classified for primary contact recreation, secondary contact recreation, propagation of fish and wildlife and drinking water source.  Under the SIC Codes 4491 and 4492, the applicant proposes to mobile barge cleaning and repair facility.  Facility proposes to discharge dry commodity vessel washwater, coal and coke washwater, incoming ballast water and void water, and facility ballast water and void water.

During the preparation of this permit, it has been determined that the discharge will have no adverse impact on the existing uses of the receiving waterbody.  As with any discharge, however, some change in existing water quality may occur.

Written comments, written requests for a public hearing or written requests for notification of the final decision regarding this permit action may be submitted to LDEQ, Public Participation Group, P.O. Box 4313, Baton Rouge, LA 70821-4313.  Written comments and/or written requests must be received by 12:30 p.m., Thursday, June 30, 2011.  Written comments will be considered prior to a final permit decision.

Finance

Discussed the Commission’s current financial report.   Hotel/Motel tax collection amount for November, 2010 was $23,966.40, for December, 2010 was $23,154.85, for January, 2011 was $21,000.53.  A report was provided to the Board regarding the expenses and funds received for the 4th quarter of 2010 and the beginning of the 1st quarter of 2011.  Motion made by Ooly LeJeune to increase the 2011 budget to include the cost of completing the website in the amount of $7850.00 that was approved in the 2010 budget but not paid in 2010.  Second by Walter R. Hays, Jr..

Advertising/Marketing

Ramon will be meeting with representatives of Where Magazine, Country Roads Magazine, Travel Host Magazine, and Petro TV to discuss advertising approved for 2011 by the Board.  He will also be meeting with Louisiana Office of Tourism staff to discuss possible grants for advertising and BP funds available for tourism marketing/advertising in Ascension Parish.   

Meetings & Activities Report

Ramon discussed the various meetings, events, and consumer shows that the staff and Board Members had participated in for October, November and December, 2010.  

Old Business

Elinda Taillon discussed the efforts to pursue collecting the remaining 2% Hotel/Motel Tax.  Most of the hotel and B&B owners were met with as well as Parish Councilmen.  All legislators were also met with.  The majority were in support of the Commission in collecting the additional 2% tax.  However, the Chairman was asked to pull the request for a resolution from the Parish Council supporting the action because legislators reported the Governor would veto any bill concerning taxes.  Ramon and Ooly LeJeune met with an attorney with the House of Representatives to determine the next course of action.   There are several pieces of legislation that need to be corrected for Ascension Parish Tourism Commission.  Motion made by Cecily Boudreaux to engage Joseph Lavigne to assist the Tourism Commission in researching the current legislation and to open a dialogue with the Governor regarding increasing the Hotel/Motel Tax.  Second by Tony Lawson.

APTC Strategies for 2012

Elinda Taillon discussed the Tourism Commission strategies for 2012.  A personnel review will be done of all job descriptions to better define specific responsibilities for all staff and evaluate each position for appropriate pay ranges.  The Commission will work with the Gonzales Tourist Commission to determine opportunities for partnership in marketing and advertising.  A condensed version of the Group Services Guide will be developed.  Procedures will be developed for bid proposals for meetings, conventions, and events.  Internet statistics from Google Analytics will be analyzed to assist in determining target markets.  Computer software will be obtained to establish an email data base for tourism partners, public officials, community partners and residents.  Change of board meeting time will be considered.  Management of building maintenance will be considered.

Board Appointment Status Update

Elinda Taillon discussed current appointments to the Board that will expire in July, 2010.  Three of the Board Members are eligible to serve another term.

Personnel

Cecily Boudreaux explained that the Personnel Committee will be reviewing the job descriptions for each employee to better define specific work responsibilities for each.  The committee will also consider certain job duties that each staff feels they are proficient in performing and their ideas for moving the Tourism Commission forward.

Ramon Gomez reported that the draft of the application for the BP Grant Funds has been submitted.  The draft application was submitted to the Louisiana Office of Tourism (LOT) for review.  LOT will contact the Tourism Commission to provide the results of the review with recommendations so that the final application can be completed and submitted to BP for approval.

Motion made by Cecily Boudreaux to authorize the Board Chairman and Secretary/Treasurer to sign on behalf of the Tourism Commission, and by his/her signature, enter into any and all contractual obligations on behalf of this Tourism Commission.  Second by Wally Taillon.

UNITED STATES OF AMERICA STATE OF LOUISIANA PARISH OF ASCENSION

ORDINANCE

Purpose:

To acquire a parcel of immovable property from St. Mark Roman Catholic Church for Purpose of constructing road improvements in the amount of NINETY THREE THOUSAND FOUR HUNDRED FIFTEEN AND NO/100 ($93,415.00) DOLLARS.

WHEREAS, The Parish of Ascension through the Department of Public Works has engaged in a road project entitled Roddy Road Final Phase; and

WHEREAS, in order to successfully complete the project, the Parish must purchase right of way in accordance with Section 6.01 of the Code of Ordinances and the Charter of Ascension Parish; and

WHEREAS, the Parish has identified certain property as necessary for the continuation of the project and desires to purchase said property all in accordance with state and local law.

BE IT ORDAINED, that the Ascension Parish Governing Authority authorizes the purchase of the St. Mark Roman Catholic Church property in accordance with the terms of the Act of Sale document attached hereto and made a part hereof as Exhibit "A." Further, the Ascension Parish Governing Authority authorizes payment to St. Mark Roman Catholic Church in the amount of $93,415.00 for the property more fully described in Exhibit "A".

BE IT FUTHER ORDAINED that the purchase of the property is subject to approval by the Parish Attorney and contingent upon the Seller being able to deliver a good and merchantable title and the Tommy Martinez, Parish President, is authorized to sign all necessary documents on behalf of the Parish.

This Ordinance is being adopted in conformity with Section 6-01 of the Ascension Parish Charter and the ordinance for approving right-of-way acquisitions adopted by the Ascension Parish Council on June 4, 2009.

This ordinance having been submitted to a vote, the vote therein was as follows:

KNOW ALL MEN BY THESE PRESENTS, for the price and on the terms and conditions hereinafter set forth, that before the undersigned competent witnesses and/or competent authority and on the dates hereinafter set out, personally came and appeared CONGREGATION OF ST. MARK ROMAN CATHOLIC CHURCH, (100% Interest), domiciled in the Parish of Ascension, State of Louisiana, herein represented by Reverend Rubin Reynolds, as authorized by an Act of Resolution, attached herewith, being hereinafter sometimes referred to as the "Vendor," whose mailing address is 42041 LA Highway 621, Gonzales, Louisiana 70737, Vendor has bargained and sold and do hereby grant, bargain, sell, transfer, assign, set over, convey, and deliver under all lawful warranties and with substitution and subrogation to all of my rights and actions of warranty, unto THE PARISH OF ASCENSION, STATE OF LOUISIANA, hereinafter referred to as "Vendee", herein represented by TOMMY MARTINEZ, Ascension Parish President. From a point on the centerline of Parish Project No. Ol-W-03, at Station 154+23.78, proceed N89"38'59"E a distance of 17.50 feet to the point of beginning; thence proceed N00°54'29"W a distance of 480.16 feet to a point and corner; thence proceed N89°45'26"E a distance of 59.00 feet to a point and corner; thence proceed S44°13'37"W a distance of 44.43 feet to a point and corner; thence proceed S00°54'29"W a distance of 448.40 feet to a point and corner; thence proceed S89°38'59"W a distance of 27.50 feet to the point of beginning. All of which comprises Parcel No. 1-4 as shown on Sheet No. 1 of the Right of Way Plans of Parish Project No. 01-W-03, and contains an area of 13,703.69 square feet or 0.315 acres.

Said TRACT 1-4 as described above contains 0.315 acres as shown on survey map prepared by Garner Morales of SJB Group, LLC.

This said sale is made for and in consideration of the price and sum of NINETY THREE THOUSAND FOUR HUNDRED FIFTEEN AND NO/100 ($93,415.00) DOLLARS, which price Vendee hereby binds and obligates itself to pay to Vendor upon acceptance by Vendee the terms of this sale agreement, for any and all interest the aforementioned Vendors have in the above described property.

It is understood and agreed that Vendor reserve unto themselves, their heirs and assigns, all oil, gas and other materials beneath the area hereinabove described, and more specifically under the provisions of Act 50 of the Regular Session of the Louisiana Legislature for the year 1974 (Title 31, Art. 1 et seq. of the Revised Statutes of 1950); it being specifically understood, however; that while no exploration, drilling, nor mining of oil, gas or other minerals of any kind shall be conducted upon the surface of the properties herein conveyed, however; there may be directional drilling from adjacent land to extract the oil, gas or other minerals from under said area.

The parties hereto take cognizance of the fact that the undersigned Notary Public has not been requested to, nor has he made, a title examination of the subject property and they agree to release and relieve him from any responsibility and liability in connection therewith. The property description was provided by the parties hereto.

The parties to this act waive the production of all mortgage and conveyance certificates and all other necessary certificates and researches, and agree to release and relieve me, Notary, from all responsibility and liability in connection with the non-production thereof.

There is specifically included in this present sale and conveyance all of the improvements situated wholly or partially on the hereinabove described property, including but not necessarily restricted to Vendor's 3,500 SF of concrete drives and parking, 1 large flood light, 4 small flood lights, large brick sign and message boards, 39 large Bradford Pear trees, 134 hawthorn bushes, and 1 large red oak tree together with the appurtenances thereto. The additional tree in the required right of way will be removed by the Parish.

The Parish shall construct four (4) commercial concrete vehicular approaches within the limits of the property herein conveyed, from the roadway to the Vendor's remaining property to the right of the centerline opposite approximate Highway Survey Stations 152+50,153+20, 153+75 and 154+25 Right of Centerline to replace the existing approaches. All approaches will include sealed keyways and expansion joints set at a maximum 10-foot layout with the joint at the

existing concrete being drilled and dowelled. In addition, all existing curbing being removed will be replaced.

The Parish shall construct one (1) commercial vehicular concrete approach within the limits of the property herein conveyed, from the roadway to the Vendor's remaining property to the right of the centerline opposite approximate Highway Survey Station 158+00 Right of Centerline to provide access to the new parking lot to be located at the north end of Vendor's property. Said approach will include sealed keyways and expansion joints set at a maximum 10-foot layout.

The Parish shall remove Vendor's existing 688.78 feet of culverts and drainage catch basins from within the limits of the property herein conveyed, and shall rebuild same at the new location of the drainage alignment for this project between approximate Highway Survey Station 152+15.03 and approximate Highway Survey Station 159+03.81 Right of Centerline.

If necessary, the Parish is hereby authorized to enter upon Vendor's property beyond the limits of the property herein conveyed for the purpose of replacing Vendor's existing 688.78 feet of culverts and three drainage catch basins.
