By virtue of and in obedience to a Writ of SEIZURE AND SALE directed to me by the Honorable 23RD JUDICIAL DISTRICT COURT in and for the PARISH OF ASCENSION, State of Louisiana, dated:  TUESDAY, JANUARY 26, 2010, in the above entitled and numbered cause, I shalI proceed to sell at public auction at the principal front door of the Courthouse Annex 828 South Irma Blvd Gonzales, La 70737 of which the Civil District Court of the Parish of Ascension is held on  WEDNESDAY, JULY  7, 2010, at 10:00 A.M., to the last and highest bidder for cash, the following described property, to wit:

PROPERTY NUMBER 1

Lot .55 ne located in the City of Donaldsonville on Lisa Street, Lot 3

PROPERTY NUMBER 2

Two certain tracts of land, lying and being in the City of Donaldsonville, Parish of Ascension, in the rear of the right of way of the Texas & Pacific Railway, being part of the property acquired by Charles Beneditto in an Act Partition dated April 15, 1941, recorded conveyance Book 78, Folio 357, Entry Number 13064, and being more particularly described according to the sketch or plat attached hereto as follows:

LOT NUMBER ONE (1):

LOT NUMBER ONE (1) fronts on its east side on St. Patrick Street a distance of 118.68 feet, by a depth between parallel lines of 201.67 feet, with a width in the rear of west side of 118.68 feet. Said LOT NUMBER ONE (1) is bounded on the north by the property of Tony Scorsone, on the east by St. Patrick Street, on the south by Lisa Street, and on the West by Lot Number Two (2).

LOT NUMBER TWO (2):

LOT NUMBER TWO (2) front on its south side on Lisa Street a distance of 201.67 feet by a depth between parallel lines of 110.68 feet, with a width in the rear or north side of 201.67 feet. Said LOT NUMBER TWO (2) is bounded on the north by the property of Tony Scorsone, on the east by Lot Number One (1), on the south by Lisa Street, and on the West by Lot Number Three (3).

Being the same property acquired by Seller herein by Act of Partition dated February 18, 1987, and recorded under Entry No. 242499 of the Official Records of Ascension Parish, State of Louisiana.

PROPERTY NUMBER 3

A CERTAIN LOT OF GROUND, together with all buildings and improvements thereon and thereto belonging, situated in the Town of Donaldsonville, Parish of Ascension, Louisiana, in that part of said town known as Churchville, and in the square bounded by Fifth Street, St. Patrick Street, Sixth Street and Bryan Alley, and being designated as LOT NO. EIGHTY-ONE (81) IN SQUARE NO. NINE (9), and measuring thirty (30') feet front St. Patrick Street, by a depth of eighty five and 321.100 (85.32') feet, and bounded as follows: In front or West by St. Patrick Street, North by Fifth Street, South by Lot No. 96 and East by Lot No. 82, being the said property acquired by the present vendor by virtue of a Administrator's sale, IN RE: Succession of Hypolite Rouseve, on the 2nd day of February, 1910, and recorded in C.B. 54, Folio 373, Being the same property acquired by Margaret Taylor Robinson from Leon Levi, by act dated September 22, 1919, before J.S. Barman, Clerk and Court , duly recorded in C.B. 61, Folio 419, of the Parish of Ascension, Louisiana.

Being the same property acquired by Nathaniel Henderson, Sr., Edward Johnson, Olivia Johnson Arcement and Eddie Johnson from the late Margaret Taylor Robinson, by Inheritance, as her sole heirs, In the Succession of Margaret Taylor Robinson, No. 3110, of the Probate Docket of the 23rd Judicial District Court, of the State of Louisiana, by judgment dated November 21, 1958, duly recorded in C.B. 159, File No. 65437, Ascension Parish.

Being the same property acquired by seller herein by Act of Cash Sale dated September 12, 1973, from Salvador Sam Bonadona and Sophie Landry Bonadona, duly recorded in C.B. ___, Entry No. 124941 of the Clerk and Recorder, Ascension Parish, Louisiana.

PROPERTY NUMBER 4

(1) A certain piece or parcel of land situated in the City of Donaldsonville, Parish of Ascension, in what was formerly Ward Four (4) together with all the buildings and improvements thereon and thereunto belonging, situated almost opposite the western terminus of Fifth Street of said City, commencing at a point two hundred thirty-eight feet (238') South of the Intersection of St. Patrick and Fourth Streets, from which point it runs in a southerly direction along the west side of St. Patrick Street, a distance of fifty feet (50') on which streets it fronts, with a depth between parallel lines of one hundred thirty-four feet (134.0').

Said property being designed as Lot One (1) in the Act of Partition in Kind dated January 14, 1963, by and between the heirs of Tony Scorsone, Sr. Recorded in CB 171, folio Entry no. 71292.

(2) All rights, title and interest of Josephine Marie Scorsone in and to what is formerly part of "Scorsone Street" adjoined by Lot No. 1 as described and set forth in the Partition of January 14, 1963.

And from the proceeds of said sale to pay petitioner by preference over all other claims, the sum of: NINETY-FIVE THOUSAND SIX HUNDRED EIGHTY-SEVEN AND 82 / 100 ($95,687.82) DOLLARS, along with interest and attorney's fees and all other costs including my own costs and charges.
