(BUDGET AMENDMENT NO. 1)

AN ORDINANCE to amend the ordinance approving, adopting, and appropriating the 2010 Operating and Capital Budgets for the Parish of Ascension, adopted by the Ascension Parish Council on the 19th day of November, 2009.

SECTION ONE.  THE ASCENSION PARISH COUNCIL HEREBY ORDAINS, that the ordinance approving, adopting, and appropriating the 2010 Operating and Capital Budgets for the Parish of Ascension, is hereby amended, approved and appropriated as follows:

PUBLIC NOTIFICATION

CITY OF GONZALES

The United States Environmental Protection Agency (EPA) and the Louisiana Department of Health and Hospitals (DHH) set drinking water standards and required the disinfection of drinking water.  Where disinfection is used in the treatment of drinking water, disinfectants combine with naturally occurring organic and inorganic matter present in water to form chemicals called disinfection byproducts (DBPs). EPA and LDHH set standards for controlling the levels of disinfectants and DBPs in drinking water, including trihalomethanes (THMs) and haloacetic acids (HAAs). Some people who drink water containing THMs in excess of the MCL over many years may experience problems with their liver, kidneys, or central nervous system, and may have an increased risk of getting cancer.

The City of Gonzales is currently in violation of the maximum contaminant level (MCL) for total trihalomethanes (TTHMs) and for haloacetic acids-five (HAA5) as set forth by the State (Part XII of the Louisiana State Sanitary Code) and the Federal Primary Drinking Water Regulations (40 CFR Part 141). In December 1998, EPA set enforceable drinking water standards for TTHMs at 80 parts per billion (ppb) and for HAA5 at 60 parts per billion (ppb) to reduce the risk of cancer or other adverse health effects. Compliance with the TTHM and HAA5 standards for public water systems serving less than 10,000 individuals initially became effective and enforceable on January 1, 2004.  Compliance with the TTHM and HAA5 standards is determined by calculating a running annual average (RAA) of quarterly TTHM/HAA5 sample results.  Compliance calculations performed for the 2008 monitoring period (May-September 2008) show that the system’s current TTHM RAA is 109 ppb and HAA5 RAA is 99 ppb; thus, the system is currently in violation of the TTHM and HAA5 standards. Compliance calculations performed for the 2009 monitoring period (May-September 2009) show that the system’s current TTHM RAA is 109 ppb; thus, the system is currently in violation of the TTHM standards.

Please share this information with all the other people who drink this water, especially those who may not have received this notice directly (for example, people in apartments, nursing homes, schools and businesses). You can do this by posting this notice in a public place or distributing copies by hand or mail.

Since being advised of the situation, the City has taken significant steps to address the issues which have been raised. The water system injection lines are being replaced and adjustments have been made to City water treatment procedures. Current test indicate that the City’s water system is operating within required standards.

This said sale is made for and in consideration of the price and sum of ONE HUNDRED FORTY-ONE THOUSAND SIX HUNDRED TWENTY AND NO/100 ($141,620.-00) DOLLARS, which price Vendee hereby binds and obligates itself to pay to Vendors upon acceptance by Vendee of

The parties to this act waive the production of all mortgage and conveyance certificates and all other necessary certificates and researches, and agree to release and relieve me, Notary, from all responsibility and liability in connection with the non-production thereof.

There is specifically included in this present sale and conveyance all of the improvements situated wholly or partially on the hereinabove described property, including but not necessarily restricted to Vendor’s residence and storage building together with the appurtenances thereto.

Purpose:

To acquire immovable property from Gloria Duplessis Hidalgo for the purpose of constructing road improvements in the amount of One Hundred Seventeen Thousand Five Hundred and 00/100 Dollars ($117,500.00). Of this amount, Nine Thousand Two Hundred Sixty Five and 00/100 Dollars ($9,265.00) represents damages and Nineteen Thousand Six Hundred and 00/100 Dollars ($19,600.00) represents and uneconomic remainder. Further, to authorize payment of relocation benefits and other related incidental expenses (such as closing costs and moving expenses) not to exceed Thirty Two Thousand Five Hundred and 00/100 Dollars ($32,500.00).

WHEREAS, The Parish of Ascension through the Department of Public Works has engaged in a road project entitled Roddy Road Final Phase; and

WHEREAS, in order to successfully complete the project, the Parish must purchase right of way in accordance with Section 6.01 of the Code of Ordinances and the Charter of Ascension Parish; and

WHEREAS, the Parish has identified certain property as necessary for the continuation of the project and desires to purchase said property all in accordance with state and local law.

BE IT ORDAINED that the Ascension Parish Council authorizes the purchase of the Gloria Duplessis Hidalgo property in accordance with the terms of the Act of Sale document attached hereto and made a part hereof as Exhibit “A.” Further, the Ascension Parish Council authorizes payment to Gloria Duplessis Hidalgo in the amount of $117,500 for the property and damages more fully described in Exhibit “A.”.

BE IT FURTHER ORDAINED that the Ascension Parish Council agrees to pay relocation expenses to Gloria Duplessis Hidalgo. The payment of these relocation expenses and replacement costs are conditioned on the mutual agreement of the Seller and a complete and final release of the Parish by the Seller. These payments are based upon the recommendation of SJB Group, LLC, employed by the Parish in connection with the Roddy Road Final Phase project. In accordance therewith, the Parish agrees to pay and does authorize payment as follows:

$22,400.00 for replacement Housing Payment Claim;

Other incidental expenses, including but not limited to moving expenses and closing costs, not to exceed $10,100.00.

BE IT FURTHER ORDAINED that the purchase of the property is subject to approval by the Parish Attorney and contingent upon the Seller being able to deliver a good and merchantable title and that Tommy Martinez, Parish President, is authorized to sign all necessary documents on behalf of the Parish.

This Ordinance is being adopted in conformity with Section 6.01 of the Ascension Parish Charter and the ordinance for approving right-of-way acquisitions adopted by the Ascension Parish Council on June 4, 2009.

KNOW ALL MEN BY THESE PRESENTS, for the price and on the terms and conditions hereinafter set forth, that before the undersigned competent witnesses and/or competent authority and on the dates hereinafter set out, personally came and appeared GLORIA DUPLESSIS HIDALGO, (100% Interest), being a resident of the full age of majority of the Parish of Ascension, State of Louisiana, whose mailing address is 14397 Roddy Road, Gonzales, Louisiana 70737, being hereinafter sometimes referred to as the “Vendor”, have bargained and sold and do hereby grant, bargain, sell, transfer, assign, set over, convey, and deliver under all lawful warranties and with substitution and subrogation to all of my rights and actions of warranty, unto THE PARISH OF ASCENSION, STATE OF LOUISIANA, hereinafter referred to as “Vendee”, herein represented by TOMMY MARTINEZ, Ascension Parish President, who accepts this sale of the following described property in the Parish of Ascension. From a point on the centerline of Parish Project No. Ol-W-03, at Station 198+72.63, proceed S89”22’l 1”W a distance of 17.50 feet to the point of beginning; thence proceed S89°22’l 1”W a distance of 64.55 feet to the point and corner; thence proceed N43°30’23”E a distance of 61.01 feet to a point and comer; thence proceed N01°25’35”W a distance of 36.21 feet to a point and corner; thence proceed N89°22’ 11 “E a distance of 21.87 feet to the point; thence proceed S01°07’49”E a distance of 80.00 feet to the point of beginning. All of which comprises Parcel No. 4-5 as shown on Sheet No. 4A of the Right of Way Plans of Parish Project No. 01-W-03, and contains an area of 2,676 square feet or 0.061 acres.

Said TRACT 4-5 as described above contains 0.061 acres as shown on survey map prepared by Garner Morales of SJB Group, LLC.

And also the westerly remainder of Vendor’s property which has been determined to be uneconomic to the owner and which, for the purpose of property identification, is assigned the parcel No. UR 4-5 (which is not so identified on the right of way plans) and such remainder being described as:

A certain tract of land situated in the Parish of Ascension, in the Southeastern Quarter of the Northeast Quarter, Section 9, Township 9 South, Range 3 East, Southeastern District of Louisiana, having a frontage of Eighty (80) feet on the West side of a gravel road by a depth between parallel lines in a Westerly direction of One Hundred Ten (110) feet and being more specifically described as follows: Commencing at the Northeast comer of a tract of land purchased by George I. Duplessis from John A. Duplessis on the 29“‘ day of September, 1947, in an Act of Cash Sale passes before C.V. St. Amant, Notary Public, and duly recorded in the official records of Ascension Parish, State of Louisiana, thence proceed in a southerly direction along the Western side of a gravel road which is the Eastern boundary line of said tract of land a distance of Eighty (80) feet to a point and comer; thence proceed in Westerly direction parallel to the Northern boundary line of said tract of land a distance of One Hundred Ten (110) feet to a point and comer; thence proceed in a Northerly direction parallel with the Eastern boundary line of said tract of land a distance of Eighty (80) feet to the Northern boundary line of said tract of land to a point and corner; thence proceed in an Easterly direction a distance of One Hundred Ten (110) feet along the Northern boundary line of said tract of land to the point of beginning.

Said property acquired by Harris Paul Hidalgo and Gloria Duplessis Hidalgo by Act of Sale with Mortgage from Picou’s Builders Supply Company, Inc., dated November 17, 1961 and recorded in the records of the Clerk of Court for the Parish of Ascension at Entry No. 70744 on January 18, 1963.
