    AN AMENDMENT TO SECTION 3.13-MOBILE HOME PROVISIONS, TO SET SPECIFIC HOURS ALLOWED FOR MOVING A HOUSE, SHED OR MOBILE HOME UPON THE STREETS AND HIGHWAYS LOCATED IN THE TOWN.
    SECTION 1-A.    HOURS ALLOWED TO MOVE STRUCTURES
       That no person may move a house, shed or mobile home upon any non-state maintained street or highway located in the Town of Sorrento, except between the hours of 8:30 p.m. and 2:30 p.m. on Monday-Friday.
       This amendment to section 3.13-Mobile Home Provisions having been introduced by Councilman Charles Day on March 20, 2012.  Notice of public hearing was published and said public hearing duly held.  The title having been read and the ordinance considered, on motion by Councilman John Wright, seconded by Councilman Milton Vicknair, to adopt said amendment, a record vote was taken and the following result was had:

       Councilman Milton Vicknair introduced Ordinance 12-03, to establish procedures for sewer back-up or leak damages to homes and businesses connected to the town sewer system.  A public hearing was called for the next regular meeting of the mayor and council on Tuesday, April 17, 2012 at 6:00 pm at the Sorrento town hall to consider adoption of this ordinance.
       Motion by Councilman Milton Vicknair and seconded by Councilman John Wright to authorize town clerk, Paige Robert to cut checks to cover the damage that occurred to their homes due to a sewer back-up and to authorize Mayor Pro-tem Randy Anny to sign the checks.  Tomeka Bureau, Sheila Butler, Delores Bureau, Dinah Bureau, Henry Celestine, Melvin Jackson, Kim Hood, Ralph Smith and Grace Brathwaite.  Motion carried.  Vote as follows:

    The Council of the Parish of Ascension, Louisiana, met in regular session on Thursday, March 1, 2012, 6:00 p.m., in the Ascension Parish Courthouse, 300 Houmas Street Donaldsonville, Louisiana with Chairman Chris Loar presiding.
    The opening prayer was offered by Chairman Loar and the pledge was led by Charlie Duhon, Manager of People’s Water Service.

    Chairman Loar proclaimed March as National Red Cross Month.  Mr. Martin McConnell, a member of the Board of Directors was there to accept the proclamation.
    Page 47 of 62 - Chairman Loar also proclaimed March 2012 as Disabilities Awareness Month in Ascension Parish. Ms. Cheryl Rice, Community Opportunities of East Ascension and Ms. Norma Dukes, the Executive Director was there to accept the proclamation.
    There was no President’s report and no items on the Consent Agenda.
    Chairman Loar announced that agenda item #8- Saltwater Intrusion – Baton Rouge aquifer – Presentation would be moved to the bottom of the agenda.
    Ms. Suzanne Hamilton, Director of the Mental Health Department respectfully requested of the Council authorization for Mental Health to obtain quotes to purchase professional liability malpractice insurance at a competitive rate for the year 2012.  A motion to approve was made by Councilman Todd Lambert and seconded by Councilman Kent Schexnaydre. No objections were made. The motion passed.
    Legal Counsel O’Neil Parenton presented the Resolution –authorizing participation in the Louisiana Enterprise Zone Program and authorization of rebate of state taxes in said Enterprise Zone.  The resolution was unanimously approved on a motion by Kent Schexnaydre and a second by Todd Lambert.
    The original motion passed and Mr. Joshua Ory was appointed to the Planning & Zoning Commission for a term ending on February 8, 2013.
    The Parish Council unanimously agreed to hold a public hearing on Thursday, April 5, 2012 6:00 p.m. in the Ascension Parish Courthouse, 300 Houmas Street Donaldsonville, Louisiana, to consider an ordinance amending the Ascension Parish zoning map by amending the zoning of a particular parcel of land located on the west side of Highway 44 approximately 1700’ north of Germany Road currently zoned as Small Planned Unit Development (SPUD) to Medium Intensity Residential (RM)   Councilman Todd Lambert made the motion and Councilman Bryan Melancon seconded the motion.
    The Parish Council unanimously agreed to hold a public hearing on Thursday April 5, 2012 6:00 p.m. in the Ascension Parish Courthouse, 300 Houmas Street Donaldsonville, Louisiana, to consider an ordinance revoking and setting aside the dedication of all roads and streets laid out and dedicated to public use within the second and third filings of Keystone of Galvez subdivision and declaring them abandoned. Councilman Todd Lambert made the motion and Councilman Dempsey Lambert seconded the motion.
    Councilman Kent Schexnaydre recused himself from the Reading, Public Hearing and adoption of the ordinance – Planned Unit Development (PUD) – Phases I, II & III – Development Agreement – Quality Engineering & Surveying, LLC.
    Legal Counsel read the ordinance. The Council unanimously opened the public hearing on a motion by Councilman Johnson and a second by Councilman Melancon. Jared Beiriger, a representative of Quality Engineering, LLC gave a brief overview and answered several questions from the Council. After a lengthy discussion, the Council unanimously closed the public hearing on a motion by Councilman Todd Lambert and a second by Councilman Benny Johnson.

    FOR BULLION CROSSING PUD
    Ver. 12.16.11
    BE IT KNOWN, that on the dates herein as executed by both parties, an agreement was made between the Parish of Ascension, hereafter identified as “Parish”, and Bullion Development, LLC, hereafter identified as “Owner”, have come to an agreement to allow construction of a Planned Unit Development, with special stipulations that shall run with the land and be of a personal obligation to each party.
    WHEREAS: Ascension Parish is a local governmental subdivision as defined by Article VI,
    Section 44 of the Louisiana Constitution of 1974, and
    WHEREAS: The Parish of Ascension is the governing and responsible body over the zoning
    and regulations within this jurisdiction, and
    WHEREAS: The Development Agreement is prepared consistent with authority of LA. Revised Statues 33:4780.21 subpart and Appendix VI, Section 17-6010(B) of the Ascension Parish LDC, and
    WHEREAS: Bullion Development, LLC, the owner of the Bullion Crossing development property, has submitted and received an approval with conditions on the concept plan identified as Bullion Crossing PUD by the Parish Council with conditions on May 5, 2011, and
    WHEREAS: The Bullion Crossing PUD was processed and approved consistent with Appendix VI of the Ascension Parish Unified Land Development Code.
    WHEREAS: The final development plan was reviewed and approved by the Planning Commission on June 8, 2011, and
    WHEREAS: This final development agreement was reviewed and approved by the Parish Council on March 1, 2012 and
    WHEREAS: The “Parish” and “Owner” come to an agreement to permit and regulate a large scale development identified as Bullion Crossing PUD and said agreements, conditions, obligations, and otherwise terms are outlined below.
    NOW THEREFORE, the following considerations, terms, conditions, and obligations are agreed to, understood, and accepted by the “Owner”:
    Primary access shall be granted from Marketplace Avenue and Enterprise Avenue.
    Emergency access shall be at Cruiser Avenue (Sills Avenue on the Final Development Plan) which shall connect to Swamp Road via an eighteen foot (18’) wide limestone drive.
    The drive shall be used for emergency evacuation purposes only when access via other means is not available through Airline Highway (U.S. Hwy 61).
    This drive shall be constructed with eight inches (8”) thick of 610 limestone over a 7 oz. non-woven geotextile fabric. Limestone driveway shall be engineered and approved by Parish Engineer to address site specific conditions.
    The drive shall have an eight inch (8”) thick concrete apron on both ends with radii size appropriately to support any emergency ingress or egress as defined in paragraph B (a) above.
    This drive shall be gated at the Swamp Road end with a fence (as depicted in the approved Final Development Plan) extending the entire frontage along Swamp Road.
    Page 49 of 62 - Owner shall adhere to the LADOTD requirements for Bullion Crossing.
    Owner has provided the 1}necessary plans and proposal to LADOTD for the J-turn intersection at LA 42 and US 61 modifications to this portion of the US 61 corridor and has complied with the LADOTD stipulations.  LADOTD will bid and construct these improvements without Owner participation.
    Owner shall install the signalization needed to allow the addition of the left-turn protected phase if the j-turn modifications are not completed in time for the school opening.
    Owner shall construct sidewalks adjacent to common areas as designated on the Final Development Plan.  
    These sidewalks (4’ wide concrete) shall be constructed prior to and inspected with the final inspection of that filing.
    The sidewalks shall be located seven feet (7’) from the back of curb within the fifty foot (50’) parish right-of-way.
    The sidewalks shall be constructed using 3,000 psi concrete, four inches (4”) thick on a stable base.
    The sidewalks shall have expansion joints every forty-eight feet (48’) with control joints every six feet (6’).
    All Handicapped Ramps will be constructed prior to and inspected with the final inspection of that filing.
    The sidewalks and ramps shall be constructed meeting the ADA standards.
    Homebuilders shall construct four feet (4’) wide sidewalks with each home prior to C.O. from side property line to property line.
    The sidewalks shall be located seven feet (7’) from the back of curb within the fifty foot (50’) parish right-of-way.
    Home Owners Association documents shall include the necessary language to require that each lot construct sidewalks with the completion of each lot.
    The sidewalks shall be constructed using 3,000 psi concrete, four inches (4”) thick on a stable base.
    The sidewalks shall have expansion joints every forty-eight feet (48’) with control joints every six feet (6’).
    Sidewalks shall connect to all Handicapped Ramps adjacent to said lot.
    The sidewalks shall be constructed meeting the ADA standards.
    The sidewalk maintenance and liability shall belong to the Developer and/or the Bullion Crossing HOA when it is created.
    Walking Trails shall be constructed by Owner prior to final inspection of the Fourth Filing as depicted on the Final Development Plan.
    Walking Trails shall be four feet (4’) wide by three inches (3”) thick and “cut into” the existing ground and shall be constructed of gravel over a weed filter barrier on a stable base.
    Pedestrian wood bridges as depicted in the approved Final Development Plan package will be constructed with the walking trails.
    Recreational Areas:
    Owner shall dedicate the areas designated as Common Area on the Final Development Plan for recreational use of the residents of Bullion Crossing.
    The installation of the amenities as shown in the Final Development plan package shall be completed prior to the issuance of half of the Certificates of Occupancy for the associated filing.

    A solid 6’ tall, 100% opaque fence will be built 1}along the eastern property line between Bullion Crossing and Commerce Center prior to the final inspection of the adjacent filing.
    Owner shall construct monument-style entry signs at the locations depicted on the Final Development Plan package prior to the issuance of half of the Certificates of Occupancy for the adjacent filing.  
    Owner shall be responsible for maintenance of the “common” areas until such time a Home Owners Association is created and legally takes over that responsibility.
    Owner shall ensure that each phase or filing adheres to the approved Drainage Impact Study.
    All erosion control measures shall remain in place and properly maintained as described in the Storm Water Pollution Prevention Plan developed to satisfy the general permit requirement of LAR 100000 and submitted to the Parish of Ascension until the Notice of Termination is submitted as required by the general permit.
    School Property
    Owner is responsible for the design and construction of the main road, sewer (including the sewer treatment facility), electricity, water, and gas related to the overall development. None of the development infrastructure is to be constructed on the school property except within dedicated servitudes. All owner supplied infrastructure shall be located at or near the property boundary line so the School Board has immediate access to, or can conveniently tie into the owner supplied infrastructure.
    Access
    Primary – Owner shall design, construct and maintain Sills Avenue and allow free access along the entire frontage as necessary.
    Emergency – The school board shall install a lock on the gate that is to be constructed, by the Developer, on the Emergency access drive as depicted on the Final Development Plan that shall only be opened when vehicle access is not available to Airline Highway.
    Sewer – Owner shall construct and maintain the Sewer Infrastructure including the Treatment Plant and piping from the School Boundary to the sewer treatment plant.
    Grading – Owner shall grade the Property as set forth on the Required Grading Survey. Owner shall remove and clear all fallen and downed trees from the entirety of the Property and shall backfill all holes created by rootballs of said trees.
    Landscaping shall be installed consistent with the approved Landscaping Plan in included in the Final Development Plan package and maintained throughout the entire project construction.
    Perimeter Landscaping shall be completed by Owner when water becomes available for irrigation within the associated filing but before the issuance of half of the Certificates of Occupancy for that filing.  
    Street tree plantings shall be installed prior to the Certificate of Occupancy being issued for the associated Lot.
    Page 51 of 62 - Park landscaping shall be completed by Owner when water becomes available for irrigation within the associated filing but before the issuance of half of the Certificates of Occupancy for that filing.  
    AND FURTHER, The following considerations, terms, conditions, and obligations are agreed to, understood, and accepted by the “Parish”:
    Variances have been granted from the current Unified Land Development Code as follows:
    Section 17-4040(A) of the LDC: Block lengths, for the street running north/south adjacent to first filing in the northern portion of the project site.
    Section 17-4040(B) of the LDC: pedestrian cross-walk between homes every 750’, to what deemed appropriate by Parish staff, not to exceed one every 750’.
    Lot width: Table B: from minimum 70’ wide to 50’ wide with curb and gutter, only in locations identified on the master plan. No lot shall be smaller in width than 50’ as measured by the code.
    Section 17-602(B) – any future amendment to the plan shall never contain multi-family dwelling units.
    Section 17-604, the Bullion Crossing PUD zoning district shall be limited to 218 lots.
    Parish grants PUD zoning approval contingent with the densities, setbacks, heights, land uses, etc. as outlined in the approved Master Plan, Ordinance ZM10-01.
    SEVERABILITY:  In the event that any portion of this agreement is ever held invalid or unconstitutional for any reason by any court of competent jurisdiction over it, such portion shall be deemed a separate, distinct, and independent provision and shall not affect the validity of the remaining portions of the agreement.
    DEFAULT / VIOLATION: Any act of violation or lack of fulfillment to any obligation herein shall be deemed a breach of contract and shall nullify the agreement in entirety until such agreement is brought back into compliance by either party. In the event of a default, violation, or expiration of the agreement, the Owner shall be notified of such violation and giving 45 days in which to rectify the situation. If such correction is not obtained or pursued by the owner within the 45 days, the Parish may issue a stop work order on any or all active permit(s) for the Bullion Crossing PUD until such conflict is brought into compliance with this agreement. No work or permits shall continue or be granted until the agreement is brought into compliance or the work being sought is brought into compliance with this agreement. This section does not preclude any federal, state, or local law of jurisdictional enforcement of the appropriate and applicable regulations in place.
    EFFECTIVE DATE:  This agreement comes into full affect the day the latest signature is executed below.
    GENERAL PROVISIONS: This agreement shall follow the following general provisions:
    This agreement is and shall constitute a contract under and in accordance the laws of the State of Louisiana.
    Page 52 of 62 - This agreement may not be changed or terminated orally.  
    This agreement and the rights, interest or obligations of Owner under this agreement may be assigned, sold or delegated by Owner to any party (the “Transferee”), without the prior written consent of the Parish, so long as the Transferee recognizes this Agreement in the Act of Transfer and Assumes the obligations of Owner under this Agreement as to the Property so transferred by Owner to Transferee. Upon the assignment, sale of transfer by Owner according to this Agreement, the Owner will be relieved of the responsibility or obligations arising under this Agreement as to the Property and obligations so assigned, sold or transferred.”  The “owner” shall provide written notice to the “Parish” of the change of “owner” and the applicable property and obligations so transferred.
    Upon full execution of this agreement, the Owner shall have this agreement recorded in the Clerk of Court within 7 business days from final execution of the agreement.
    A certified recorded copy shall be provided to the Parish Planning and Development Department within 7 business days from recording.
    Amendments may only be made with both parties agreeing in writing and recording.
    No other change in regulation, jurisdiction, or outside 3rd party influence shall affect this agreement, including but not limited to relaxation in policy or ordinances, change in political jurisdiction, etc.
    All communication pertaining to this agreement shall be certified mail to the below locations:

    Councilman Benny Johnson made a motion to recess in order to get ready for the Saltwater Intrusion Presentation. Councilwoman Casso seconded the motion and the Council recessed.
    The Council unanimously reconvened on a motion by Councilman Benny Johnson and a second by Councilman Oliver Joseph.
    Mr. A. Hayes Town, Jr. gave a presentation on the Saltwater Intrusion.
        
    Legal Counsel O’Neil Parenton read a proposed resolution – urging and requesting the Louisiana Commissioner of Conservation to call a hearing regarding the lowering of the water table under the Parish of East Baton Rouge due to excessive pumping of groundwater and the acceleration of the intrusion of salt water into Ascension Parish’s drinking water.  Councilman Dan Satterlee made a motion to approve the Resolution. Councilwoman Terri Casso seconded the motion. Councilman Kent Schexnaydre amended the motion to add “Ascension” as an area of concern to the resolution. Councilman Johnson seconded the amended motion. The motion passed.

    WHEREAS, this parcel of land was originally zoned Medium Intensity Residential (RM)
    And was changed to Small Planned Unit Development (SPUD); and
    WHEREAS, the time period for which to develop the property as a Small Planned Unit Development (SPUD) has lapsed.
    THEREFORE THE PARISH OF ASCENSION HEREBY ORDAINS, that the property located on the west side of Highway 44 approximately 1700’ north of Germany Road more fully described on the map attached hereto and made a part as Exhibit A be rezoned from Small Planned Unit Development (SPUD) to Medium Intensity Residential (RM).
    REPEAL: All ordinances or parts of Ordinances in conflict herewith are hereby and henceforth repealed.
    SEVERABILITY: If any provision of this Ordinance is held to be invalid, such invalidity shall not affect other provisions herein which can be given effect without the invalid provisions, and to this end the provisions of this Ordinance are hereby declared to be severable.

    To enter into a cooperative endeavor agreement between the City of Gonzales and Ascension Parish Government and Ascension Parish Fire Protection District No. 1., of certain movable property owned by the City of Gonzales, for the purpose of transferring and donating ownership of one 2003 Crown Victoria bearing VIN 2FAFP71W93X220833, to Ascension Parish  Government and Ascension Parish Fire Protection District No. 1.
    WHEREAS, City of Gonzales, owns a 2003 Ford Crown Victoria bearing VIN 2FAFP71W93X220833 and wishes to share use in an effort to enhance and facilitate the performance of fire protection and control measures within the boundaries of both Ascension Parish Fire Protection District No. 1 and City of Gonzales.

    Mrs. Pujol said it was indeed with mixed emotions that she makes the recommendation to accept the retirement of Ms. Deborah Capello, Principal of Galvez Primary School.  She has had a phenomenal storied career in Ascension Parish.  She has been a wonderful leader and served our students so well and influenced so many teachers.  She has shaped our community.    Mrs. Pujol said that although she is sad to see Ms. Capello leave she is excited for new opportunities for her.  It was moved by Mr. Gautreau and seconded by Mrs. Russo to approve the above recommendation.  The following vote was taken:

    The committee was shown potential site plans for Freshman Academy concepts at existing Ascension Parish High Schools. Mr. Lynch will come back to the Committee with proposed budgets for these projects. Mrs. Pujol discussed potential funding strategies and potential timelines for the Freshman Academy Concept and other Facility’s needs. The committee gave input on the funding strategy and timeline for the Superintendent to consider.
    This concluded the Strategic Planning Committee Meeting.
    Mr. Irvin said that the Facility Management Committee met tonight.  The following report was given:
    Mr. Lynch explained that a servitude agreement is needed with Ascension Water Company to facilitate extension of water service to the site of New G.W. Carver Primary School.  Mr. Lynch explained that a written servitude agreement is being prepared. Once the agreement is prepared, it will be added to the upcoming school board agenda for approval.
    Mr. Chad Lynch notified the committee that Ascension Consolidate Utility District requested that the School Board change from People’s Water Service to the ACUD1 water service at Donaldsonville Primary.  This request is currently in legal review.  Mr. Lynch will return to the committee at a later date to provide a rate comparison between the two companies and to provide the outcome of the legal review.
    Mr. Lynch presented an update on the status of all ongoing construction projects. (This Construction Status update has been posted on the Ascension Parish School Board website.)
    Mrs. Wimberly scheduled a Personnel Committee Meeting for Monday, April 2, 5:00 P.M.
    Under Superintendent’s Comments, Mrs. Pujol noted the following:
    A resolution is in board member packets from St. Landry Parish School Board regarding unfunded mandates
    March 30th is the deadline to make any cancellations for the NSBA Conference
    There were no additional Board Comments.

    SOLICITATION OF PROJECT
    PROPOSALS
    Louisiana Emergency Solutions Grants Program
    The Ascension Parish Council has been issued an application package for the Emergency Solutions Grants Program (ESGP) administered by the Louisiana Department of Children and Family Services (DCFS).  Funding available under the Emergency Solutions Grants Program is dedicated for the rehabilitation, renovation, or conversion of buildings for use as shelters for the homeless, and for payment of certain operating costs and social services expenses relating to homeless emergency shelter.  The Program also allows funding for use in homeless prevention activities as an adjunct to other eligible activities.
    Applicants for grants under the State ESG Program are limited to units of local government which may distribute all or part of their grant amounts to private nonprofit organizations for use in eligible Program activities.  Nonprofit organizations interested in developing a project proposal for possible inclusion in an ESGP funding application under consideration by the Ascension Parish Council may request a copy of the proposal materials by contacting Hermina Edward-Irvin at (225) 621-1128.
    To qualify for funding participation, a private nonprofit organization as defined by Program regulations must be one which is exempt from taxation under subtitle A of the Internal Revenue Code, has an accounting system and a voluntary board, and practices nondiscrimination in the provision of assistance.  Matching funds (including in-kind contributions) equal to the amount of grants funds must be provided except under special circumstances when an exemption can be allowed.  Program rules require that ESGP recipients involve, to the maximum extent practicable, homeless individuals and families in ESG funded activities, including constructing, renovating, maintaining, and operating facilities assisted under the ESG Program, and in providing services for occupants for these facilities.
    Page 62 of 62 - No funding obligations shall be implied based on information in this solicitation of ESGP project proposals.  The Ascension Parish Council reserves the right to accept any proposal or reject any and all proposals on such basis as may be deemed to be in its best interest.  The deadline for receipt and consideration of a proposal is 12:00 noon April 24, 2011.

    NOTICE IS HEREBY GIVEN that the following entitled ordinance was introduced in writing in the form required for adoption at a meeting of the Parish Council of the Parish of Ascension, State of Louisiana, on April 4, 2012, and laid over for publication of notice:
    ORDINANCE
    An Ordinance directing a renewal of the levy and collection of a special ad valorem tax of 2.0 mills on all property subject to taxation within the boundaries of the Parish of Ascension, State of Louisiana, commencing with the tax collection for the year 2012, and annually thereafter, to and including the year 2021, to provide funds to the Parish of Ascension to be used to maintain and support the Ascension Parish Public Health Center, including buildings, maintenance expenses and other related health care expenses.
    NOTICE IS HEREBY FURTHER GIVEN that the Parish Council of said Parish will meet on May 3, 2012, at 6:00 p.m., at the Donaldsonville Courthouse, 300 Houmas Street, 2nd Floor, Donaldsonville, Louisiana, at which time there will be a public hearing on the adoption of the aforesaid Ordinance.
