    One (1) certain lot or portion of ground, together with all of the buildings and improvements thereon situated in the Parish of Ascension, in the Southeast Quarter of Section 31, Township 9 South, Range 3 East, Southeastern Land District of  Louisiana, designated as Lot 6 of Kennedy Heights Estates Subdivision, as shown on the final plat of KENNEDY HEIGHTS ESTATES SUBDIVISION, made by Norris J. Decoteau, Registered Land Surveyor of ADCO Engineers & Planners, Inc., dated Baton Rouge, Louisiana, December 28, 1984  duly recorded in COB 380, Folio 28 of Ascension Parish. Said lot having such measurements and dimensions and is subject to such servitudes and building set back lines as are shown in detail on the plan of survey referred above.

    Being the same property acquired by Jos T. Cafiero from Maginnis land and Improvement Company on March 9, 1908, by deed duly recorded in Book 51, folio 383.
    Further being the same property acquired by Mrs. Alice Cafiero Montero, wife of Arthur L. Montero, by Act of Donation from Mrs. Frances Victore Cafiero, widow of Joseph T. Cafiero, dated August 30, 1926, executed before Walter Lemann and recorded in COB 66, at folio 150.

    Page 25 of 57 - The Louisiana Department of Environmental Quality and CF Industries, Inc., Agency Interest Number 2416, have entered into a proposed settlement agreement, Settlement Tracking No. SA-AE-11-0045, concerning the State’s allegations of environmental violations by Respondent at its facility in Ascension Parish, Louisiana, which allegations are set forth in Consolidated Compliance Order & Notice of Potential Penalty, LDEQ Enforcement No. AE-CN-08-0144.
    The Department of Environmental Quality will accept comments on the proposed settlement for the next forty-five (45) days.  The public is invited and encouraged to submit written comments to the Louisiana Department of Environmental Quality, Office of the Secretary, Legal Affairs Division, Post Office Box 4302, Baton Rouge Louisiana 70821-4302, Attention: Jay Glorioso, Attorney.  All comments will be considered by the Department of Environmental Quality in reaching a decision on whether to make the settlement final.

    Discuss Comp Time and Holidays for Exempt Employees
    Cecily Boudreaux provided clarification regarding Board policy on employee comp time and holidays.  Full time exempt employees have three designated paid holidays, New Year’s Day, Thanksgiving Day and Christmas.  If those days fall on a weekend when the employees are off, no pay is received for that day and employees are not given a work day off before or after that holiday.  Currently there are eight additional rotating holidays for the 2 full time exempt employees.  Each employee is allowed to take four of these holidays and will be paid for those holidays.  The employee who actually works those four holidays will not receive comp time or another day off after working those holidays. Exempt employees do not earn comp time for any hours worked over 40 per week.  It is understood that flex time of an hour or two will be allowed when needed as long as functions of the office are satisfied.   It should be noted that, as long as the APTC building operates as a tourist welcome center, the building must be open to travelers on the 8 rotating holidays.  Therefore, exempt employees shall split the duty of manning the operation on those days.  No comp time will be awarded to any exempt employee for time over 40 hours or for working rotating holidays.  However, flex time is permissible, as long as functions of the office are satisfied. 
    Page 27 of 57 - General discussion regarding viability of 2012 Travel Shows
    Ramon provided a spreadsheet detailing proposed Southeast La. Gumbo Group travel show participation for 2012 and expenses associated with that participation.  In order to make a decision on APTC’s participation, the Board requested that information describing each type of travel show be provided for review.  The option of having tourism partners assist in participation at the travel shows will also be considered.  The Board was unable to determine the value of such shows with the information presented.  Ramon was asked to provide convincing testimony that the returns for attending travel and /or consumer shows can justify the relatively high price of travel and time away from the business of operating a small marketing operation, such as the Ascension Parish Tourism Commission.  Ramon was also asked to provide the individual packets of information describing each of the 2012 travel/consumer shows.
    Discussion and vote on APTC Administration Agreement with Parish of Ascension
    Ooly LeJeune discussed the need to make a decision regarding renewing the agreement with the Parish of Ascension to provide payroll, telephone and tax collection services.  She confirmed that APTC participates in the Louisiana Parochial Retirement System. The Finance Committee will look into the feasibility of continuing the agreement with the Parish and will make a recommendation to the Board by December 1, 2011.

    CHAPTER 5  BUILDINGS AND BUILDING REGULATIONS* ARTICLE IV. PLUMBING CODE. DIVISION 1. GENERALLY (CHANGE) TO (ADD) Sec. 5-184 to read:
    Sec. 5-184. Cross-Connection Control Devices
    (a) The City of Gonzales shall maintain records of cross-connection hazard surveys along with records of the installation, testing, and repair of all backflow prevention assemblies installed for containment purposes.  The City of Gonzales may take additional actions which may not be specifically covered herein that are deemed necessary to protect the City of Gonzales’s water supply from potential or actual cross connections in accordance with the requirements of the Louisiana State Plumbing Code, latest edition.
    (b)  New Water Services
    The City of Gonzales shall approve the type of backflow prevention assembly or method required for containment.
    The City of Gonzales shall require the installation of the appropriate backflow prevention assembly or method for containment before the initiation of water service.
    (c)  Existing Water Service
    Any changes of, or additions to, existing water services shall be treated as new water services for the purpose of the ordinance.
    Each customer shall survey the activities and processes which receive water service and shall notify the City of Gonzales if cross-connections exist along with the degree of hazard.  Upon the identification of a cross connection hazard, the customer shall cause the appropriate backflow prevention assembly or method to be installed in a timely fashion.
    For existing water services, the City of Gonzales may inspect the customer premises to determine the degree of hazard.  The City of Gonzales shall have the right to enter, with the consent of the customer, or upon the basis of a suitable warrant issued by a court of appropriate jurisdiction, any property to inspect for cross-connections.  Upon identification of a hazard, the customer shall cause the appropriate backflow prevention assembly or method to be installed in a timely fashion.
    When high hazard cross-connections are found the City of Gonzales shall:
    Develop a schedule of compliance which the customer shall follow, or
    Terminate the water service until a backflow preventer assembly or method for containment required by the City of Gonzales has been installed.
    Failure of the City of Gonzales to notify a customer that the customer has a high hazard cross-connection and should install backflow prevention assemblies or methods for containment in no way relieves the customer of the responsibility to comply with all requirements of this section.
    (d) Utility Customer Responsibilities
    Utility customers shall be responsible for ensuring that no cross-connections exist without approved backflow protection within the customer’s premises starting at the point of service from the public potable water system.
    Page 52 of 57 - Utility customers shall, at the customer’s own expense, cause installation, operation, testing, and maintenance of backflow prevention assemblies required by the City of Gonzales.  The customer shall advise the City of Gonzales in advance of when a device is to be tested to allow the city the opportunity to witness the test.
    Utility customers shall test the backflow prevention assembly using a certified, registered tester annually.  If the customer fails to test the assembly within the annual testing period, as defined by the City of Gonzales, the city shall have the authority to terminate water service until the required inspection is complete and a report of the inspection is submitted to the City of Gonzales.  
    Within fifteen (15) days after testing and/or repairs are completed, the customer shall provide the City of Gonzales with copies of records of the installation and of all tests and repairs made to the backflow prevention assembly.
    In the event of a backflow incident, utility customers shall immediately notify the City of Gonzales of the incident and take steps to confine any contamination or pollution.  Water service will not be restored until corrective action is taken and approved after inspection by the City of Gonzales.
    In accordance with SectionD108.3.4 of the LSPC, 2000 Edition, utility customers shall maintain records of installation, tests, repairs, overhauls, or replacements of backflow prevention devices or methods for at least five (5) years and, upon request, such records shall be made available to the City of Gonzales.

    The Petition of L & L Investment Corporation, a Louisiana Corporation, organized and doing business in the City of Gonzales, Parish of Ascension, respectfully represents as follows:

    Pursuant to the provisions of R.S. 33:171 et seq. Petitioner requests the extension of the corporate limits of the City of Gonzales by annexation to include within the corporate limits the following real estate owned by Petitioner:
    A certain tract or parcel of land, together with all the buildings and improvements thereon, situated in the Parish of Ascension, State of Louisiana, and being described on a plan of survey entitled “Survey Map of 77.503 Ac. (2.868 ac. In road r/w) of the R.     ORDINANCE
    DC01-12
    PURPOSE: To amend the Ascension Parish Subdivision Regulation Section 17-405.D.2
    WHEREAS, the Parish of Ascension has in effect a comprehensive plan of zoning and pursuant to that plan, a parish wide development code was adopted by the Ascension Parish governing authority which became effective on June 1, 1999;
    WHEREAS, the Ascension Parish Development Code provides for a procedure for its amendment of the development code and related regulations and restrictions by initiation of the Parish Planning and Zoning Commission;
    WHEREAS, the Parish Planning and Zoning Commission has initiated an amendment to Section 17-405.D.2 of the Ascension Parish Subdivision Regulations to define certain sign requirements for developments;
    NOW THEREFORE, BE IT ORDAINED that Section 17-405.D.2 of the Ascension Parish Subdivision Regulations is amended as follows:
    2. Public Notice requirements
    Notice of the time and place of the public hearing shall be mailed by certified mail to the owner/sub-divider and all adjacent property owners as identified by the Ascension Parish Tax Assessors office at the time of the submittal and at the applicants sole cost, by the Planning Commission staff.
    Page 56 of 57 - The public hearing shall be advertised in the Ascension Parish official journal.
    Prior to any hearing before the Planning Commission, the site must be posted by the applicant with sign(s) that meet the following requirements for public notice:
    i. Parcels of land 20 acres or greater in size shall place a sign facing each public right-of-way it has frontage on as follows;
    Sign(s) must be no more than 10 feet from the access way and free of any physical obstruction that could obscure visibility of the sign.
    Sign(s) must be no more than 1,200 feet apart per frontage.
    Sign(s) must be placed on the subject property a minimum of 10 calendar days prior to the scheduled hearing date.
    Developer must deliver to the Planning and Development staff, photos of installed sign(s) a minimum of 10 days prior to the scheduled hearing date.
    Photo(s) of the installed sign(s) must include the date and time digitally identified on the photo(s).
    Developer must include a graphic depiction of the sign location(s).
    Developer shall install a sign(s) that meets the following standards:
    Sign(s) must be a minimum of 24” x 30” in size and must be a minimum height of 5’ to the center line of the sign
    Sign(s) must have a yellow background with black letters.
    Signs must be double faced and oriented perpendicular to the travel lane.
    Sign(s) must state the following information:
    Type of the proposed development or subdivision
    Public hearing date and time
    Public hearing location
    4)    Parish contact information
    Parcels of land smaller than 20 acres shall place one sign that meets the requirements of Section 17-405.D.2. The sign must be posted at the midpoint along the thoroughfare it fronts, provided, the location must not impede any existing ingress or egress or other physical attribute of the parcel of land. In such cases, it should be placed as close as possible to the mid-point of the frontage.
    iv.    Final Plats shall be excluded from these requirements.
    d. The sub-divider and/or his representative shall be present at the public hearing to explain the proposal and answer questions.
    SEVERABILITY: In the event that any portion of this Ordinance is ever held invalid or unconstitutional for any reason by any court of competent jurisdiction over it, such portion shall be deemed a separate, distinct, and independent provision and shall not affect the validity of the remaining portions of the Ordinance.
    EFFECTIVE DATE: This ordinance shall be in full effect as permitted by law. This ordinance having been submitted to a vote, the vote thereon was as follows:
